군행형법 개정의 의미와 문제점

국문 초록

1962년에 군교정에 관한 특수 행정법인 군행형법이 최초로 제정된 이래 2009년 이전까지 여러 차례의 부분적인 수정이 있었는데 이러한 국지적인 수정은 소위 역사적 제도주의에서 말하는 기존의 제도를 수확체증적으로 자기확대를 하는 경로의존적인 개정이란 점에서 큰 의미가 없었다. 그러나 2009년에 전면 개정되어 2010년 5월부터 시행에 들어간 개정군행형법은 기존의 경로의존적인 개정에서 벗어날 만큼 이전의 개정과는 본질적으로 다른 전면 개정이란 점에서 군행형법 개정사에서 획기적인 일 이지만 여전히 주변부적 지위에 있다 보니 이 부분에 대한 연구는 거의 없다. 그리고 군행형법은 행정법과 교정복지적 측면에서 접근이 가능지만 여기에서는 주로 교정복지를 중심으로 한 학제적 접근을 하였다. 우선 기본배경으로서 먼저 행정법으로서의 군행형법의 지위와 내용을 기술하였다. 그다음에는 행형이념에 대해 선행연구를 소개하고 발전적인 관점에서 비판하였다. 그다음에는 전면 개정된 군행형법의 내용과 의의 및 문제점에 대해서 살펴보았다. 먼저 개정군행형법의 내용을 군수용자의 인권강화, 군수용자의 건강권 강화, 군수용자의 외부교통권 강화, 군수용자에 대한 교화프로그램의 강화, 군교정행정의 민주성 강화로 나누었다. 그리고 개정군행형법의 의의를 인권복지적 측면, 가족복지적 측면, 교정복지적 측면, 의료사회복지적 측면, 산업복지적 측면으로 나누어 사견으로 운론하였다. 그리고 군교정복지레짐은 민간복지레짐에 잔여적(residual)이며 군보안 생산레짐이라는 상징레짐에 보완적이고 하위기능으로만 존재한 경로의존적인 군행형법 개정의 한계를 운론하였다. 그리고 개정군행형법의 문제점을 교정이념적 측면, 인권적 측면, 교정재 생산레짐적 측면, 교정재 생산프로그램적 측면으로 나누어 학제적 관점에서 기존의 주류이론들과는 전혀 다른 관점에서 독창적으로 상술하였다.

영문 초록

This paper dealt with the meaning of the amendment of the military criminal administration act. Although many amendment of the amended military administration before the year 2009 have been executed, they seem to have not shown the important significance of the amendment of it in the light of the existing path-dependence amendment which is derived from the historical institutionalism inclusive of the law of increasing return. But the amendment in 2009 of the military criminal administration is essentially different from the existing partial amendment of it on the ground that the amendment in 2009 of it can get out of the existing path-dependence amendment of it. But there has been no study that tried to deal with the amended criminal administration act in 2009 in spite of the epoch-making amendment in the history of the amendment of th military criminal administration act. In consequence in this study, I will concentrate on the following issue : significance of it and problem of it. To begin with, space is limited, I concentrated on and explored in my opinion military prisoner's human rights, military prisoner's medical rights, military prisoner's communication with their family, correctional welfare service for military prisoners, democratic contents of the military correctional administration and the like on contents of the wide military correctional social welfare. In turn, I dealt with the significance and problems of the amended military criminal administration act in 2009 through reviewing human rights social welfare, family social welfare, correctional welfare, medical social welfare, industry social welfare and so on. Especially, I invoked the citizenship theory of T.H marshall and the de-commodification theory of Esping-Andersen and the like in the social welfare policy science for the dynamic and macro understanding of the amended military criminal administration act. In consequence, We can understand the residual limit of it and the path-dependence amendment of the military criminal administration act which is dependent on the civil criminal administration act. And there is a further question which needs to be asked in the military criminal administration act. It is the adoption of the path-breaking perspective through the military correctional paradigm as social welfare ideology in military prison instead of the correctional paradigm as the administrative management ideology linked with existing path-dependence.
