교통유도경비 제도의 도입에 관한 연구

국문 초록

교통유도경비업무는 도로에 접속한 공사현장 및 사람과 차량의 통행에 위험이 있는 장소 또는 도로를 점유하는 행사장에서의 부상 등 사고발생을 방지하는 업무이다. 우리나라는 그동안 도로 및 건설현장에 관련된 법규에서 교통안전 및 시설, 교통유도에 관한 규정을 두었으나 제대로 시행되지 못하였다. 그 결과 각종 공사현장이나 도로점용 공사장으로 인하여 공사차량 출입, 일반차량과 보행자의 상충, 부적절한 교통안전시설물의 설치 등으로 교통혼잡과 교통안전에 많은 피해를 가져왔다. 또한 도로를 점유하는 대형 행사장 및 옥외 집회 현장은 교통사고의 위험성이 높고 차량 및 사람의 통행에 불편을 가중시켜 도로 이용자에게 많은 피해를 주고 있는 실정이다. 따라서 이러한 공사구간이나 행사현장의 안전에 대한 대책이 요청되고 있는 실정이다. 조진형 의원 등이 2009년 12월 4일 경비업법 일부개정법률안에서 교통유도경비업무를 도입하는 안을 발의하였다. 이 제도가 성공적으로 도입되어 정착하기 위해서는 우선 경비업법이 산업안전보건법, 건설기술관리법, 도로법, 도로교통법, 국토해양부의 도로공사장 교통관리지침, 서울시의 도로점용공사장 교통소통대책에 관한 조례 등과 조화를 이뤄야 할 것이다. 일본 등에서 교통유도경비업이 전체 경비업의 35% 정도를 차지하는 것으로 볼 때, 우리나라에서도 과다경쟁이 일어날 가능성이 높다. 따라서 허가기준을 엄격히 하여 도입 초기에 교통유도경비업체가 건전하게 육성되도록 해야 할 것이다. 또 교통유도경비업의 성패는 교통유도경비원의 교육에 달려있다. 교통유도경비업의 중요성의 기술성을 감안하여 특수경비원과 같이 88시간의 신임교육이 필요할 것이다. 일본의 경우는 신임교육 30시간과 현임교육 연2회 각 8시간의 교육을 받고 있다. 그리고 교육과정과 과목, 시간 등은 업계, 학계, 관계기관 등이 함께 논의하여 적절한 방안을 마련하여야 할 것이다. 전문인력을 양성하기 위한 교육과정과 함께 자격 검정제도를 적극적으로 검토할 필요가 있을 것이다.

영문 초록

Economic growth, cities' development due to increase in income, and following increase in traffic demand have brought about social cost like marginal congestion cost. This has eventually has caused undermined national competitiveness and inconvenience in livelihood of the public. In particular, there are several obstacles preventing smooth traffic flow such as road construction, construction work near roadway, and frequent traffic jams in commercial area. Those factors can cause heavy traffic congestion, even deadly consequences to the public. Recognizing those problems, after holding large events such as 1964 Tokyo Olympic and 1970 Osaka World Exposition, in 1972, Japan government has enacted traffic flagging system as security job, clause two of Security Industry Act. And the traffic flagging has been applied diverse places where traffic congestion or safety accident easily occurs: on express and typical roadway, on construction sites, in public places, and in case of emergency. This job has had an effect on smooth traffic flow, decrease in risk of traffic accident. Also, it has reduced police's heavy workload and doing accident prevention job in urban blocks out of police's reach. As of December 2009, 63.1%(5,765) among the total 8,998 security companies in Japan have offered traffic flagging services. Those companies have went through rapid growth after introducing traffic flagger system, and their security sales account for 10% of total gross(3,113.7 billion yen). In Korea, on the other hand, although there have been needs for solution for traffic congestion and for improvement of police working condition, there are no effective countermeasures. Given this context, this study analyzes the current state of Korean traffic system and suggests the traffic flagger system as an avaliable private security system that can be done in public-private cooperation.
