여성경찰 임용의 실태 및 문제점에 관한 고찰

국문 초록

최근 경찰조직에 대한 여성들의 관심이 높음에도 불구하고 경찰조직에서 여성들이 차지하는 비율은 낮다. 경찰조직의 여성비율은 유사한 직종의 다른 형사사법 기관에 비교하여서도 매우 낮은 것으로 나타났다. 이것은 채용과정에서 여성을 남성과 분리 모집하여 그 수를 제한하고 있는데 기인한다. 경찰은 성별분리모집의 원인을 경찰직무를 감당하기에 상대적으로 취약한 여성의 체력적 한계를 그 원인으로 들고 있다. 그러나 실질적으로 경찰직무 수행에 있어 없어서는 안될 가장 중요한 요소가 체력적 강인함이라고는 볼 수 없다. 그리고 체력이 매우 중요하다면 경찰 채용시 국민들의 평균체력보다 우월한 기준 혹은 적어도 유사한 기준을 제시하여야 함에도 불구하고, 남성을 기준으로 경찰은 국민의 평균 체력에 미치지 못하는 체력기준을 설정하여, 경찰업무에 있어 체력의 중요성을 스스로 간과하였다. 물론 경찰의 직무특성 상 우수한 체력을 가지고 있는 사람을 경찰공무원으로 채용한다면 직무수행에 용이한 것은 당연하다. 그러나 그것이 체력수준에 따른 차이가 아닌 성에 따른 차별이 되어서는 곤란하다. 경찰의 직무상 체력적 요건이 필요하다면, 그리고 그 기준이 적용되어야 한다면 남녀의 차이를 둘 것이 아니라 통일된 기준을 설정하고, 그 기준을 남성이든 여성이든 통과한다면 동등한 기회를 제공하여야 할 것이다. 이외에도 경찰의 계급구조를 살펴볼 때, 경찰조직에서 상위계급에서의 여성경찰의 비율은 남성경찰에 비해 매우 적음을 알 수 있었다. 또한 승진에 있어서도 여성경찰과 남성경찰의 경우 차이점이 발견되었다. 여성경찰은 시험승진이 높은 반면 남성경찰은 심사승진이 높았다.

영문 초록

Although the women increasingly interested in police organization recently, the rates of woman police are low. And the rates of woman working in police organization are really low compared to criminal justice organizations. There are many reasons of these unpair management, one of the most important reason is hiring police persons by distinguishing their sex. So the percentage of police woman's rates to total police officers are 5∼6%. The National Police Agency asserted clearly that the performance of work such as the arrest of criminals, suppression of demonstration, and handling of drunks is the original and representative works of police persons so as to judge the entire ability of police persons by their performance of such work. And it is supposed that police persons have to be physically stronger than others in order to under take duties arrest and suppression. And that women are not appropriate for police work as they are weaker than men. But most police performance of work need not to require physical force. Also, this study pointed out that if the physical forces are really important, the standards of physical ability in police recruitment system are so high. But the standard of physical ability test currently adopted for hiring police officers does not even reach the average level of general people. If the police organization, of course, hires police officers who have good physical ability, the performance of work are easy due to the nature of the police work. Yet, it is not sexual discrimination but physical ability discrimination. The National Police Agency should try to establish a standard for physical constitution and strength that can evaluate the necessary abilities to undertake police work. And whoever meet the standard, they should be police officers. And the rates of police woman are low compared to police man in a higher position. Also, about a promotion, there was a difference in the two police groups-women and men.
