국문 초록

이 연구는 보호관찰 청소년의 위반행동을 설명하기 위한 통합적 분석 틀을 제시하고, 이에 영향을 미치는 요인을 실증적으로 규명하고자 하였다. 레크리스(Reckless)와 디니츠(Dinitz)의 비행유발이론을 기반으로 비행 유발 요인을 압력요인, 유인요인, 배 출요인으로 분류하고, 각 요인이 위반행동에 미치는 영향을 구조적으로 분석하였다. 한국형사정책연구원의 2018년 ‘소년원생 실 태조사’ 2차 데이터를 활용하여 실증연구 하였으며, 보호관찰 이행 과정에서 나타나는 위반행동을 단순한 일탈이 아닌 제도 효 과의 지표로 간주하였다. 연구결과, 여자 청소년이 남자 청소년보다 보호관찰 경고처분 경험률이 유의미하게 높게 나타났으며, 연령이 높을수록 위반 가능성이 증가하는 경향을 보였다. 그러나 압력요인, 유인요인, 배출요인은 위반행동에 통계적으로 유의 미한 영향을 미치지 않았다. 이 연구는 기존의 재범률 중심 접근을 보완하며, 보호관찰 청소년의 행위 이탈을 구조적·심리적·사 회문화적 요인의 상호작용 속에서 해석함으로써 실효성 있는 개입 전략 수립을 위한 정책적 시사점을 도출하고자 하였다.

영문 초록

This study aims to present an integrated analytical framework to explain the delinquent behavior of juveniles on probation and to empirically identify the factors that influence it. Based on Reckless and Dinitz's theory of delinquency, we classified delinquency-inducing factors into pressure factors, attraction factors, and discharge factors, and structurally analyzed the impact of each factor on delinquent behavior. The analysis used secondary data from the Korea Institute of Criminal Policy Research's 2018 ‘Survey of Juvenile Prisoners’ and considered offending behavior during probation implementation as an indicator of system effectiveness rather than mere deviation. The analysis showed that female juveniles were significantly more likely to experience probation warning dispositions than male juveniles, and the likelihood of violation tended to increase with age. However, pressure, attraction, and discharge factors did not have a statistically significant effect on violation behavior. This study complements the existing recidivism-centered approach and attempts to draw policy implications for effective intervention strategies by interpreting the behavioral deviance of probationers in the interaction of structural, psychological, and sociocultural factors.
