북한군의 민간인 대상 범죄 실태와 과제

국문 초록

북한군에 대한 논의의 중심은 대개 북한군이 보유하고 있는 핵무기나 생화학무기 같은 대량살상 무기에 맞춰져 있다. 그러나 북한군의 규모와 운영체계, 보급 실태, 인권의식 등을 고려할 때 북한군 내부의 인권침해는 매우 열악한 것으로 보이며 전반적인 보급과 인권상황이 개선되지 않을 경우 북한군의 인권문제는 민간인에게 확대될 가능성이 매우 높다. 따라서 북한 군대에 의한 민간인 피해, 특히 인권피해 사건에 대한 실태와 영향을 분석하여 북한 군대에 의한 인권침해의 예방과 개선 방안의 도출 및 향후 과거사 청산과제를 위한 자료 확보는 매우 중요하다. 북한군에 의한 민간인 범죄 실태를 알아보기 위해 관련 문헌 분석과 더불어 북한군 경험이 있는 남성 70명을 대상으로 조사를 하였다. 주요 조사 항목은 민간인 살해, 민간인 폭행, 민간인 약탈, 민간인 강제노동, 민간여성 성폭행 등이다. 조사 결과를 통해 나타난 북한군에 의한 민간인 범죄는 심각한 수준임이 드러났다. 북한 군대는 식량과 보급품 부족이 만연한 상태이며, 군인들은 국가 재산은 물론이고 민간인 소유물을 약탈하여 열악한 상황을 개선하고자 하고 있다. 약탈 과정에서 민간인의 살해, 폭행, 강제노동과 여성 성폭행 사건이 발생하고 있다. 북한 군대의 인권문제와 특히 민간인 대상 인권문제는 반인도범죄(crimes against humanity)에 포함될 수 있으며, 향후 사법적 처벌의 대상이 될 수 있기 때문에 시급한 개선책이 요구된다. 이를 위해 북한 군인들의 인권문제와 민간인 대상 인권범죄와 관련하여 북한 여군과, 북한군 각 군종별, 병종별에 대한 보다 세부적인 조사가 필요할 것으로 보인다. 이러한 조사 결과를 바탕으로 북한군과 민간인 대상 인권문제의 개선을 위한 노력을 북한 당국에게 촉구해야 할 것이다.

영문 초록

Generally discussions surrounding the North Korean military largely focus on weapons of mass destruction such as the nuclear and biochemical weapons possessed by the North Korean military. However, when considering the scale of the military, the operation system, state of distribution and levels of human rights awareness, the severe human rights violations within the North Korean military are clear. In the case that the state of provisions and internal human rights violations do not improve, it is highly likely that human rights issues within the military spread to civilians. Therefore, it is important to analyze the civilian casualties committed by North Korean soldiers, with a particular focus on the state and effect of the human rights incidents in order to search for methods to improve the human rights violations in the North Korean military as well as to gather the appropriate data needed for future transitional justice tasks. In order to investigate the crimes against civilians perpetrated by the North Korean military, a literary analysis as well as interviews with 70 men with experience in the North Korean military were conducted. The main areas of research included civilian casualties, civilian assault, looting, forced labor and sexual assault against civilian women. The research results revealed the gravity of the state of military crimes committed against civilians. The North Korean military has a widespread shortage of food and supplies, as a result, soldiers attempt to improve conditions by not only plundering state property but also civilians'. It is during these lootings that civilians are killed, assaulted forced to carry out labor and also sexually assaulted. The human rights issues in the North Korean armed forces, in particular the violations committed against civilians, can be considered to be part of crimes against humanity and are subject to judicial penalties in the future. As a result, further research is needed on the human rights of North Korean soldiers and the crimes against civilians through extensive research on female soldiers, as well as according to different troops and branches of the military. Based on such research results, the North Korean authorities will be urged to improve the human rights conditions of the North Korean armed forces as well as to make efforts to solve the issues of military crimes committed against civilians.
