국문 초록

본 연구는 여성폭력 피해자가 탈폭력 과정에서 직면하는 주거 불안정과 상실 상황 등 주거 위기를 지원할 방안 모색을 목적으로 한다. 이를 위해 주거권 보호 조치를 강화해 온 사례로서 미국의 연방법인 「여성폭력방지법(The Violence Against Women Act, 이하 VAWA)」의 주거 지원 방식과 작동 맥락을 분석하여 국내 제도에 주는 시사점을 탐색하였다. 검토 결과, VAWA를 통해 피해 유형을 포괄하여 지원하는 미국은 주거 상실 시 가능한 장기주택을 확보하고 유지할 수 있도록 다양한 보조금을 지원한다. 또한 상대적으로 민간 주택시장에서 주거 확보가 어려운 주택 프로그램 이용자를 VAWA의 보호 범위 내로 포괄하여 가해자와 점유권 분할, 긴급 이전 보장 등 안전을 위한 조치를 강화해 온 것을 알 수 있었다. 정책 작동 기반으로 각 주정부의 법적인 차이를 보완하는 연방법 내의 주거권 보호를 위한 구체적인 조치 방안과 관련 전달체계의 역할 명시, 유연하고 적절한 재원의 확보 등이 드러났다. 이를 바탕으로 국내에서도 여성폭력 피해자가 기존 주거를 상실하지 않을 제도적인 보호조치 강화 방안과 피해자의 복합적이고 다양한 상황에서 주거 선택지 확장을 위해 고려할 점을 제시하였다.

영문 초록

This study aims to explore ways to support housing crises, such as housing insecurity and loss situations, that victims of violence face during the process of escaping the violence. To this end, as a case example of measures for stronger protection of housing rights, the context of operation of the Violence Against Women Act (VAWA), a US federal law, were analyzed to explore the implications for the Korean domestic system. The analysis results show that, the US, which supports a wide range of victims through VAWA, provides various grants to help them secure and maintain long-term housing in the situation where they lost their homes. It was also found that housing programs that are relatively difficult to secure in the private housing market have been included within the scope of VAWA protection, strengthening safety measures such as splitting the tenancy rights with the abuser and guaranteeing emergency relocation. This shows that the US policy is built upon the specific measures for protecting the right to housing within the federal law that complements the legal differences among states while stipulating the roles of relevant policy delivery systems and securing adequate financial resources in a flexible way. Based on this, this study proposes measures to strengthen institutional protection so that victims of violence against women in Korea do not lose their existing housing and to expand housing options for victims in diverse and complicated situations.
