절차적 정의에 관한 국민의 인식이 경찰 수사권 지지에 미치는 영향

국문 초록

2020년 형사소송법 개정 이후 종래에 검사에게 집중되었던 수사권의 조정이 이뤄지면서 경찰의 1차적 수사권과 자율권이 대폭 확대되었을 뿐 아니라 불송치권이 부여됨으로써 경찰도 수사 종결권의 일부를 확보할 수 있게 되었다. 특히, 수사권 행사는 형사사법체계 속에서 국가의 형벌권을 부과하는 과정으로서 자유와 권리를 제한하는 성격이 매우 강하고, 형사소송절차를 현실에서 구체적으로 실현한다는 측면에서 절차적 성격 또한 강한 작용이다. 따라서 실체적 정의와 함께 헌법상 법치주의를 준수하고 절차적인 정당성을 확보하는 것이 매우 중요하며 이러한 정당성은 시민의 신뢰 내지 지지로 평가받을 수 있다. 따라서 이 연구는 경찰의 수사권 행사에 있어서 확보·구현되어야 할 절차적 정의에 대하여 국민은 과연 어느 정도 기대하고 있고 어떠한 노력을 요구하고 있는지를 확인하고, 이러한 인식이 경찰의 수사권과 종결권 지지에 미치는 영향을 실증적으로 검증하는 것을 목적으로 하였다. 이를 위해 절차적 정의에 관한 이론적2025-02-17·형사법적 근거를 기초로 수사구조 개혁에 관한 국민 인식 조사 데이터를 수집·재구성하여 분석·논의하였다. 연구결과, 절차적 정의에 대한 국민의 기대 및 요구 모두 경찰의 수사 자율권 지지에 유의한 영향이 나타났고, 수사 종결권 지지의 경우에는 절차적 기대가 유의한 영향을 미친다는 것이 검증되었다. 이러한 결과를 토대로 법원칙에 따른 절차적인 한계를 준수하는 것 외에도 경찰의 절차적 수사 전문성 향상을 위한 전문인력의 확충 및 교육 강화, 수사 공정성 및 중립성 유지·강화를 위한 법·제도 등의 절차적 환경 개선과 함께 무엇보다 피의자와 피해자와 같은 상대방을 대하는 절차적 태도가 개선될 필요가 있다는 시사점을 도출하였다.

영문 초록

Following the 2020 amendment to the Criminal Procedure Act, the investigative authority, which was previously concentrated with prosecutors, has been adjusted. This adjustment has significantly expanded the primary investigative authority and autonomy of the police, and granted them the authority to not forward cases, thereby allowing the police to secure part of the investigative conclusion authority. The exercise of investigative authority, particularly within the criminal justice system, is a process of imposing the state's punitive power, which strongly restricts freedom and rights. It also has a strong procedural nature in terms of realizing criminal procedure in practice. Therefore, it is crucial to ensure procedural legitimacy along with substantive justice and to comply with the rule of law as stipulated in the Constitution. This legitimacy can be evaluated through the trust and support of citizens. This study aims to empirically verify the extent to which the public expects and demands procedural justice in the exercise of police investigative authority, and how this perception affects support for police investigative authority and conclusion authority. Based on theoretical and criminal justice law grounds for procedural justice, the study collected and restructured public perception survey data on investigative structure reform for analysis and discussion. The study results indicate that both public expectations and demands for procedural justice significantly influence support for police investigative autonomy. In the case of support for investigative conclusion authority, procedural expectations were found to have a significant impact. Based on these results, the study suggests that, in addition to adhering to procedural limits according to legal principles, it is necessary to improve procedural attitudes towards counterparts, enhance police investigative expertise through the expansion and strengthening of professional personnel and education, and maintain and strengthen the fairness and neutrality of police investigative authority through legal and institutional improvements.
