우리나라 실물 주민등록증 제도의 개선 연구

국문 초록

우리나라의 주민등록법령상 전 국민들에게 강제적 내지 의무적으로 주민등록증을 발급받게 하는 제도는 개인정보자기결정권을 침해한다는 등의 이유로 위헌적 제도라고 비판하는 일부 소수의 견해들이 있다. 그러나 동(同) 제도는 우리나라의 국방·치안·조세·사회복지 등의 여러 행정사무들을 신속하고 효율적으로 처리할 수 있도록 해 준다는 점에 의하여 타당한 제도라고 판단된다. 다만, 현재 우리나라의 실물 주민등록증의 겉 표면에 여러 중요하고 내밀한 개인정보들인 주민등록번호·상세한 주소·지문 등을 표기해서, 독일 및 일본의 전자적 실물 국가신분증과 비교해 볼 때, 타인에게 거의 무방비 상태로 비교적 쉽게 노출시켜서 각종 범죄 등에 악용될 수 있게 하는 문제점이 있다. 따라서 향후 우리나라는 독일과 일본의 전자적 실물 국가신분증에서처럼 실물 주민등록증 안에 전자적 IC칩을 새롭게 의무적으로 탑재토록 개선한 후에 현재처럼 외부에서 쉽게 알아볼 수 없도록 이러한 전자적 IC칩 안에 여러 중요하고 내밀한 개인정보들인 주민등록번호·상세한 주소·지문 등을 입력해 넣고, 개인의 신분증명이 필요한 경우에 한해서, 암호화된 개인 비밀번호를 통해서 별도의 국가가 공인한 리더기나 판독기를 통해서 개인의 신원을 증명할 수 있는 여러 중요하고 내밀한 개인정보들을 확인해 볼 수 있도록, 향후 우리나라의 주민등록법령상 관련 규정들을 적절히 제·개정할 필요가 있다. 한편 향후 우리나라의 실물 주민등록증을 예를 들면, 독일처럼 전자적 IC칩을 삽입한 후에 그 전자적 IC칩 안에 개인의 여러 중요하고 내밀한 개인식별번호, 상세 주소, 지문, 전자서명 등을 내장 내지 수록토록 개선해서, 만약 실물 주민등록증을 오프라인 또는 온라인에서 사용이 필요한 경우에 자동으로 암호화되어 해당 공공기관이나 민간부문에 전송하여 전자적으로 읽혀서 전자적 IC칩 안에 내장된 해당 필요한 여러 개인정보들이 자동적으로 입력되도록 개선해 줘서, 개인이 서면에 일일이 실물 주민등록증의 전자적 IC칩 안에 수록되어 있는 여러 개인정보들을 불편하게 기재하지 않도록, IT 과학기술 사회에서 우리나라의 실물 주민등록증의 편리성과 안전성 및 효율성을 크게 제고시키는 것이 바람직하다.

영문 초록

There are some opinions that criticize the system that compulsorily or compulsorily requires all citizens to be issued a resident registration card under Korea's resident registration law and ordinance as an unconstitutional system for violating the right to self-determination of personal information. However, the system is considered reasonable because it allows Korea to quickly and efficiently handle various administrative affairs such as national defense, security, taxation, and social welfare. Currently, various important and intimate personal information such as resident registration numbers, detailed addresses, and fingerprints are marked on the surface of Korea's real resident registration card, and compared to Germany and Japan's electronic real national ID cards, it is relatively easy to expose to others in a defenseless state so that they can be abused for various crimes. In the future, Korea needs to properly enact and revise related regulations in Korea's resident registration law and ordinance so that it can not be easily recognized from the outside after improving the electronic IC chip to install an electronic IC chip as in Germany and Japan's electronic real national ID cards. In the future, Korea's real resident registration card will be improved to embed or include various important and intimate personal identification numbers, addresses, fingerprints, and electronic signatures in the electronic IC chip after inserting an electronic IC chip, for example, like Germany. If the real resident registration card is needed offline or online, it will be automatically encrypted and transmitted to the relevant public institution or private sector to automatically input the necessary personal information embedded in the electronic IC chip. It is desirable to greatly enhance the convenience, safety, and efficiency of Korea's real resident registration card in the IT science and technology society so that individuals do not conveniently write down various personal information contained in the electronic IC chip of the real resident registration card.
