국문 초록

본 연구는 우리나라의 기업형태별 조세부담의 차이가 사업자들의 개인기업 또는 법인기업 선택에 영향을 주는가를 비상장 소규모 기업을 대상으로 분석하였다. Duncane-Leigh의 자기선택모형(Duncane-Leigh’s self-selectivity model)을 토대로 한 분석결과, 2007년의 경우 개인기업의 유효세율이 법인기업의 유효세율보다 커질수록 개별사업자는 기업형태의 선택에서 개인기업을 많이 선택하는 것으로 나타났는데, 이는 일반적인 합리적 의사결정방향과 반대로 되는 결과이다. 그러나 2009년의 자료를 사용한 분석에서는 개인기업의 유효세율이 법인기업의 유효세율보다 커질수록 기업형태의 선택에서 법인기업을 선택하는(증가하는) 것으로 나타났다. 결과적으로 본 연구의 분석은 개별사업자가 2008년의 세법개정으로 법인기업으로의 기업형태 선택 및 전환을 통해 조세부담을 줄이는 것으로 나타났다.

영문 초록

This study attempts to analyze the effects of tax burden rate difference between individual firm and incorporated firm on the choice of organizational forms by small-sized Korean firms. This study adopts the self-selectivity model in order to take into consideration that the choice is not influenced by external factors but by the firm itself. The major findings of the empirical analysis are as follows. In 2007, as the effective rate of tax on the individual firm became larger than that on the incorporated firm, the incentive to choose the individual firm increased. This result of 2007 is contrary to prediction of the model. But after the amendment of the tax law in 2008, the incentive to choose the incorporated firm increased in 2009, because the effective rate of tax on the individual firm became larger than that on the incorporated firm.
