국문 초록

본 연구는 법무전문직 진입이 개인의 능력이나 노력의 결과에 국한되지 않고, 고소득층의 지위 유지를 위한 전략이자 취약계층의 계층 상승 수단으로 작동하는 사회적 진로 결정의 결과임을 밝히고자 한다. 이를 위해 법학전문대학원 입학을 준비 중인 대학 재학·휴학·졸업(예정)자 19명과, 법학전문대학원 재학생 및 졸업 후 변호사시험 결과 대기자 21명 등 총 40명을 대상으로 심층 인터뷰를 수행하였다. 질적연구를 기반으로 한 분석은 참여자의 진로 선택 동기와 진로 준비 과정에 미치는 사회경제적 요인의 영향을 중심으로 이루어졌으며, 이를 위해 국가장학금 소득 구간, 부모의 직업, 출신 대학, 성별, 전문직 친족 유무 등으로 수행하였다. 연구결과는 5개의 주제로, ‘경제적 안전과 명예 추구’, ‘자신이 가진 자원을 최대한 활용하기’, ‘한국 노동시장 내 성차별이 법무 전문직 진입의 영향’, ‘법무 전문직 친족의 영향’, ‘불안한 취업시장에서 불확실성 회피’으로 나타났다. 연구참여자들은 자신의 학력 및 경제적 자원을 활용하여 법무전문직 진입을 준비하였고, 이러한 과정에서 기회 사재기(opportunity hoarding)와 사회적 폐쇄(social closure)의 메커니즘이 작동함을 확인할 수 있었다. 법무전문직은 본질적으로 높은 진입 장벽을 지닌 폐쇄적 영역이며, 고학력·고소득층 배경을 가진 집단이 진입 가능성을 독점하고 있었다. 이러한 결과는 법학전문대학원 제도가 계층 재생산을 강화하는 방향으로 작동됨을 인식하였다. 또한, 진입 장벽 완화를 위한 장학금 확대 등의 경제적 지원 제도에 대한 필요성을 제안하였다.

영문 초록

This study reveals that entry into the legal profession in South Korea is not solely the result of individual merit or effort, but rather a socially structured occupational decision functioning both as a strategy for status preservation among the affluent and a means of upward mobility for the disadvantaged. To this end, in-depth interviews were conducted with 40 participants: 19 individuals currently preparing for admission to law school—including current university students, students on leave, and recent graduates—and 21 law school students or recent graduates awaiting the results of the National Bar Examination. Based on a qualitative research design, the analysis focuses on how socioeconomic factors shape participants’ occupational motivations and preparation processes. Key indicators considered—such as state scholarship income brackets, parental occupation, educational background, gender, and the presence of legal professionals in the family—are used to identify classed pathways into the profession. The findings are organized around five key themes: (1) the pursuit of economic stability and social recognition; (2) the exploitation and mobilization of available resources; (3) the impact of gender discrimination in the Korean labor market on legal career decisions; (4) the motivational role of familial ties to legal professionals; and (5) risk aversion amid a precarious job market. Participants actively utilized their educational and economic capital to navigate the competitive admission process, illustrating mechanisms of opportunity hoarding and social closure in access to the legal profession. Despite institutional reforms toward a professional graduate law school model, the legal profession remains exclusionary, disproportionately favoring individuals from prestigious universities and affluent families. These findings demonstrate that the law school system reinforces class reproduction under the guise of meritocracy. The study contributes to research on professional stratification by illuminating how institutional transitions intersect with enduring social hierarchies. It also emphasizes the need for expanded financial aid programs, such as full scholarships, to lower structural barriers to entry.
