국문 초록

본 연구는 소방기관이 작성한 감정결과보고서가 형사사법 절차에서 정식 증거로 채택되지 못하고 참고자료에 머무르는 구조적 한계를 규명하고, 이를 개선하기 위한 제도적 대안을 제시하는 데 목적을 두었다. 이를 위해 2014년부터 2024년까지의 화재조사보고서 제출 현황을 정보공개청구를 통해 수집하고, ｢소방청 통계연보｣와 ｢경찰통계연보｣를 활용한 정량 분석을 실시하였다. 동시에 제천⋅밀양⋅고양⋅이천⋅평택 등 5대 중대 화재 사건을 선정하여 질적 사례분석을 병행하였다. 분석 결과, 감정촉탁 절차 없이 자체 작성된 보고서는 법원의 증거능력을 인정받지 못하거나 수사기관에서 참고자료 수준으로만 활용되는 경우가 다수 확인되었으며, 사건별 활용 편차와 초동수사 단계에서의 배제 문제가 반복적으로 드러났다. 이에 따라 본 연구는 제도개선 방향으로 감정서 간주 조항 신설, 공동감정촉탁 제도 도입, 감정서 표준화 및 감정인 인증체계 구축을 핵심 대안으로 제안하였다.

영문 초록

This study aims to identify the structural limitations that prevent fire investigation expert reports, prepared by fire agencies, from being recognized as formal evidence in criminal proceedings, where they are often relegated to the status of mere reference materials. The study also seeks to propose institutional reforms to overcome these limitations. To this end, data on the submission of fire investigation reports from 2014 to 2024 were obtained through information disclosure requests, and quantitative analysis was carried out using the Fire Agency Statistical Yearbook and the Police Statistical Yearbook. Additionally, qualitative case studies were conducted on five major fire incidents—Jecheon, Miryang, Goyang, Icheon, and Pyeongtaek. The analysis revealed that reports not based on court-appointed expert requests were frequently denied evidentiary status by the courts or used only as supplementary documents by investigative authorities. Significant discrepancies in the utilization of these reports across cases were also identified, including their repeated exclusion during early investigative stages. Based on these findings, this study proposes the following key policy recommendations: the enactment of statutory provisions recognizing certain fire investigation reports as admissible expert evidence, the implementation of a joint expert request system at the early stages of investigation, the standardization of report formats, and the establishment of a professional certification system for fire investigators.
