국문 초록

본 연구는 2025년 3월 기준 전국의 243개 지방자치단체 중 28개 지방자치단체가 제정한 고령 장애인지원 조례를 분석하여 지방자치 시대의 고령 장애인 정책 방향을 모색하는 것을 목적으로 한다. 연구 방법으로는 국가법령정보센터의 자치 법규 시스템을 통해 수집한 28개 조례를 대상으로 ‘사회복지 조례의 내용적 체계 비교분석 틀 및 측정’을 활용하여 내용 분석을 실시하였으며, 대한민국 정보공개 포털을 통해 조례 이행 현황을 검토하였다. 분석 결과, 고령 장애인지원 조례의 내용적 체계에서는 지자체별로 권리성, 적용 대상, 급여 종류의 포괄성, 재정 책임, 전달 체계, 인력 전문성에서차이가 나타났다. 조례 이행 실태분석에서는 지원계획수립(28.6%), 실태조사(14%), 사업 추진(46%) 측면 모두 낮은 이행률을 보였다. 연구 결과를 바탕으로 고령 장애인지원 조례의 임의 규정과 노력의무규정을 강행 규정으로 개정할 필요가 있으며, 고령 장애인 연령에 대한 기준의 탄력적 운영지침마련, 장애인 정책 종합계획에 고령 장애인지원 항목 포함 및 정책 영향평가, 조례 제정 및 이행 실태에 대한 정기 평가 체계 구축, 전달 체계의 통합성과 책임성 강화를 정책적으로 제언하였다.

영문 초록

This study analyzes ordinances established by 28 local governments nationwide to support elderly persons with disabilities. The goal is to explore policy directions for this population in the era of local autonomy. The research methodology involved conducting a content analysis of the 28 ordinances collected through the Local Regulations System of the National Legal Information Center using the “Comparative Analysis Framework and Measurement of the Content Structure of Social Welfare Ordinances,” as well as reviewing the implementation status of the ordinances through the Republic of Korea Information Disclosure Portal. The analysis revealed differences among local governments regarding the rights-based nature, scope of application, comprehensiveness of benefits, financial responsibility, delivery system, and professional expertise of personnel in the content structure of ordinances supporting elderly persons with disabilities. Analysis of the implementation status showed low rates in all areas: support plan establishment (28.6%), status survey conduct (14%), and program implementation (46%). Based on these results, the discretionary provisions and effort obligations in the ordinances must be revised into mandatory provisions. The study also recommended establishing flexible guidelines for age criteria for elderly persons with disabilities and incorporating them into the comprehensive disability policy plan. Other recommendations include conducting policy impact assessments and establishing a regular evaluation system for the enactment and implementation status of the ordinances, as well as strengthening the integration and accountability of the delivery system.
