‘조력존엄사’가 한국 사회에 미칠 영향: 해외 사례를 통한 선제적 고찰

국문 초록

2024년 말 초고령사회에 진입한 한국 사회에서는 생애 말기 의료와 돌봄에 대한 관심이 그 어느 때보다 높으며, 여론 조사에 따르면 국민 중에 이른바 ‘조력존엄사’ 합법화를 기대하는 비율도 높다. 2022년에 이어 2024년 연명의료결정법 개정안으로 조력존엄사 즉 일반적으로 의사조력자살이라고 하는 행위를 합법화하는 법안이 현재 국회에 상정되어 있다. 이에 본 논문은 안락사를 합법화한 국가들에서 합법화 이후에 일어난 변화와 문제점에 대해 분석한다. 안락사가 가능한 연령과 대상의 확대, 호스피스 완화의료의 약화, 돌봄이 필요한 사회적 약자에 대한 안락사의 시행과 같은 문제점을 지적한 후, 이를 기반으로 한국에서 만일 합법화가 될 경우 어떤 문제가 일어날지에 대해 논의한다. 한국의 높은 고령자 자살률과 빈곤율, 생애 말기 의료 및 돌봄 시스템의 미비, 그리고 현행 한국 의료 시스템 하에서 의사조력자살을 허용했을 경우 우려스러운 점이 많음을 지적하였다. 고령자의 증가는 사망자가 늘어남을 의미하는데 이런 다사(多死) 사회로 전환을 앞둔 한국에서 좋은 죽음을 맞이하기 위한 방법에 대해 모색한다.

영문 초록

As South Korea rapidly transitions into a super-aged society by late 2024, public interest in end-of-life care has reached an unprecedented peak. Public opinion polls also indicate a high level of expectation among citizens for the legalization of “Assisted Dignified Death”. A bill to amend the “Act on Decisions on Life-Sustaining Treatment”, aiming to legalize “Assisted Dignified Death”(generally understood as physician-assisted suicide), has been submitted to the National Assembly. This paper analyzes the changes and challenges observed in countries that have legalized euthanasia/physician-assisted suicide. This analysis highlights critical issues, including the broadening of eligibility criteria, the erosion of hospice and palliative care services, and the implementation of euthanasia/physician-assisted suicide for vulnerable individuals in need of care. Building on these observations, we then discuss the potential problems that could arise if such legislation were enacted in South Korea. Significant concerns are underscored given South Korea's high suicide rate and poverty rate among the elderly, the inadequacy of its existing end-of-life medical and care systems, and the generally low quality of death experienced. Furthermore, numerous worrisome implications are pointed out if “Assisted Dignified Death” were permitted under the current Korean healthcare system. Finally, recognizing that an increasing elderly population inevitably leads to a rise in deaths, this paper explores strategies for achieving a good death in South Korea as it stands on the cusp of becoming a “mass-death” society.
