국문 초록

본 논문은 디지털 치료제의 도입과 더불어 새롭게 제기되는 환자 자율성과 동의 절차에 관한 윤리적 쟁점을 검토한다. 국내 최초로 허가된 디지털 치료기기인 ‘솜즈(Somzz)’를 사례로 삼아, 자동화되고 비가시적으로 이루어지는 디지털 치료 환경에서 기존의 ‘충분한 정보에 근거한 동의(informed consent)’ 모델이 환자의 자율성을 실질적으로 보장하는 데 한계가 있음을 확인한다. 이에 필자는 ‘과정적 동의(processual consent)’ 개념을 제안하며, 설명가능한 기술 설계, 사용자 중심 인터페이스, 디지털 및 건강 문해력 향상을 위한 사회적 지원 등의 필요성을 강조한다. 이러한 접근은 환자의 ‘상황적 자율성’을 실현하고, 디지털 치료제의 윤리적 정당성과 신뢰성을 제고하는 핵심 조건이 될 수 있다.

영문 초록

This study explores the ethical challenges related to patient autonomy and informed consent that have emerged alongside the rise of digital therapeutics. Using Somzz, the first government-approved digital therapeutic device in South Korea, as a case study, the paper contends that in highly automated and opaque digital treatment environments, the conventional model of informed consent is insufficient for meaningfully safeguarding patient autonomy. To address this limitation, the study introduces the concept of processual consent, which highlights the necessity of iterative, context-aware communication throughout the therapeutic process. Furthermore, it emphasizes the critical role of explainable system design, user-centered interface development, and socio-educational support in enhancing patients’ digital and health literacy. These elements are essential for promoting ‘situated autonomy’ and ensuring the ethical legitimacy and trustworthiness of digital therapeutics.
