스토킹범죄 예방을 위한 정책적 우선순위 결정에 관한 연구: AHP 분석을 중심으로

국문 초록

다소 늦은 감이 없지 않으나, 지난 6월 21일 국회가 본회의를 통해 스토킹처벌법과 관련하여 제기된 다양한 문제를 해결하였다는 점에서 매우 고무적이다. 그럼에도 불구하고, 스토킹범죄와 관련해 여전히 해결해야 할 과제들이 많이 남아 있다. 이에 본 연구에서는 법률적 관점의 논의에서 다소벗어나 새로운 관점에서 보다 실효성 있고, 처방적인 스토킹범죄 예방을 위한 대안을 모색하고자 하였다. 따라서, 본 연구에서는 스토킹범죄 예방을 위한 대안으로 대분류 차원에 3가지 변수(경찰체제 정비, 가해자 치료·교정, 대국민 스토킹 근절 공감대 형성)를 그리고 그 하위변수로 총 10개의 변수를 도출하였다. 연구방법은 다양한 대안들 중 우선적으로 고려해야 할 요소가 무엇인지를 쉽게 찾아낼 수 있는 기법인 AHP 분석을 활용하였으며, 설문대상은 네 집단으로 분류(경찰공무원, 경찰행정 학과 교수, 국책 연구기관 연구원, 경찰인재개발원·중앙경찰학교 교수 요원)하여 진행하였다. AHP 분석결과 가장 높은 중요도 값을 보였던 변수는 스토킹 전담경찰관 확대(0.271732)였고, 그 다음 순으로 스토킹 범죄예방 및 대응을 위한 예산 확대(0.179441), 피해자 신변보호 장치 확보(0.106038)로 나타났다. 이러한 분석결과를 근간으로 본 연구에서는 다음과 같은 정책적 함의를 모색하였다. 첫째, 전담경찰관의 기능과 업무를 세분화하여 구체적으로 정립하고, 전문성 있는 인력을 충원해 피해자 보호의 사각지대를 없애야 할 것이다. 즉, 형식적 인력배치로 업무의 효율성이 떨어지지 않도록 합리적 증원과 배분이 이루어져야 한다. 둘째, 근본적인 스토킹범죄 근절을 위해 보다 폭넓은분야에 대한 예산지원이 필요하다. 셋째, 피해자의 실질적 신변보호를 위해 수사와 재판 중인 피의 자에게 심리적 변화가 있는지의 유무를 확인하여, 심리적 이상 징후가 있을 경우 피해자에게 즉각 통지하는 조치로 추가 피해가 발생하지 않도록 하여야 한다.

영문 초록

Although it is somewhat late, it is very encouraging that the National Assembly resolved various issues raised in relation to the Stalking Punishment Law on June 21st through the plenary session. Nevertheless, there are still many problems to be solved about 'stalking crime'. Therefore, this study tried to find an alternative for more effective and normative stalking crime prevention from a new point of view rather than a discussion from a legal point of view. Therefore, in this study, as an alternative to stalking crime prevention, three variables(police system alignment, perpetrator treatment/correction, and public consensus on stalking eradication) were selected at the level of major classification, and a total of 10 variables were derived as sub-variables. As a research method, AHP analysis is used to easily find out which factors should be considered first among various alternatives. In addition, the survey group was divided into four groups(police officials, police administration professors, national research institute researchers, professors of police human resources development institute, and central police academy). As a result of the AHP analysis, the variable with the highest importance was 'expansion of police officers dedicated to stalking' (0.271732), followed by 'expanding the budget for stalking crime prevention and response' (0.179441), and 'secured personal protection devices for victims' (0.106038). Through these analysis results, this study sought the following policy implications. First, it is necessary to subdivide the functions and duties of the police officers in charge and to recruit specialized personnel to eliminate blind spots in victim protection. In other words, reasonable increase and distribution should be made so that work efficiency does not deteriorate due to formal manpower allocation. Second, budget support for a wider range of fields is needed to fundamentally eradicate stalking crimes. Third, for the actual protection of the victim, it is necessary to check whether there is any psychological change in the suspect during the investigation and trial, and if there is any sign of psychological abnormality, the victim is immediately notified so that additional damage does not occur.
