집회시위에 있어서 경찰 드론 활용방안에 관한 연구

국문 초록

최근 경찰은 실종자수색에 드론을 활용함으로써 많은 성과를 내고 있다. 이에 경찰에서는 다양한경찰업무는 물론, 집회시위 현장에서 드론을 활용하기 위한 방안을 모색하고 있다. 따라서 본 연구는 경찰이 집회시위 현장에서 드론을 활용하기 위한 방안을 모색하기 위해 수행되었다. 연구 방법은문헌연구를 바탕으로 외국 제도와 비교 분석하였고, 미국, 영국, 프랑스, 독일의 사례를 비교 검토하였다. 선행연구와 판례 등을 비교검토하고 현장의 의견을 분석한 결과 다양한 문제점을 제시하였다. 법·제도상의 문제점으로 현 제도 하에서 경찰이 집회시위에 드론을 사용하기 위해서는 법적 근거가 마련되어야 하며, 드론 운영상 문제점으로는 '경찰 무인비행장치 운용규칙'을 비롯한 드론 활용 법적 근거 미약, 개인정보침해 우려, '항공안전법' 특례조항 적용 문제, 사고 발생 시 보상과 책임 문제, 해외 사례 검토 부족을 제시하였다. 이에 따른 개선방안으로 '경찰 무인비행장치 운용규칙' 제9 조 개정, '경찰관 직무집행법' 제5조 개정, '항공안전법' 특례조항 명확화, 드론 채증장비 운용규정명확화, 드론 안전성 향상 및 보상체계 확립, 개인정보 침해 소지 해소, 해외 사례의 정확한 홍보 등을 제시하였다. 결론적으로 경찰이 집회시위 현장에서 드론을 활용하기 위해서는 ‘경찰 무인비행장치 운용규칙’과 ‘경찰관 직무집행법’ 개정을 통해 법적 근거를 선행적으로 마련하고, 이와 동시에 경찰의 드론 운용 부서 확대와 현재 사용하는 드론의 경량화를 비롯한 다양한 종류의 드론을 구매하여 활용하는 것이 바람직하다. 하지만, 경찰의 드론 활용은 인권과 질서유지의 종합적인 관점에서 검토되어야 할 필요가 있다. 결론적으로, 집회시위 현장에서 경찰이 드론을 활용하는 것이 집회의 자유를 보장함은 물론 효과적이고 안전하게 질서유지를 하는데 기여할 것이다. 본 연구가 집회시위의 보장과 개인의 기본권 보장, 안전하고 공정한 법 집행이 이루어지기 위해 집회시위에 드론을 활용하기 위한 기초자료가 되기를 바라며, 다양한 후속 연구들이 이어지기를 기대한다.

영문 초록

This study was conducted to find ways for the police to use drones in assembly & demonstrations. The research method was compared and analyzed with foreign institutions based on literature research. The cases of the United States, the United Kingdom, France, and Germany were reviewed to explore the grounds and consideration factors for using drones for assembly and demonstrations in Korea. As a result of the study, it was analyzed that in order for the police to use drones for assembly and demonstrations under the current system, legal grounds must be established, and drones can be used at assembly sites only when problems such as privacy and personal information infringement are solved. In particular, the United States, France, the United Kingdom, and Germany have prepared and operated laws to use drones or are already using drones at assembly sites based on precedents, and are expanding their use by clarifying legal grounds. It suggested weak legal grounds for drone use, concerns over personal information infringement, special provisions of the Aviation Safety Act, compensation and responsibility in the event of an accident, lack of overseas case review. In conclusion, in order for the police to use drones in assembly sites and rally demonstrations, legal grounds were prepared by revising the Police Unmanned Flying Device Operation Rules and Act on the Execution of Duties by Police Officers Act, and at the same time, it was suggested to purchase and utilize various types of drones. It is clear that safety measures to save multiple lives are more important values than the legal interests of individuals' information protection. It is hoped that this study will serve as basic data for the use of drones in assembly and demonstrations to guarantee the right of assembly and demonstrations, guarantee basic rights of individuals, and ensure safe and fair law enforcement, and various follow-up studies will continue.
