국문 초록

최근 가상자산에 전 세계적 관심이 집중됨에 따라 각종 범죄 및 테러 등에 가상자산을 이용하려는 행위가 급증하고 있다. 최근 들어 가상자산 관련 불법행위 검거 건수 및 피해액이 8배 이상 증가하였 으며, 국제테러 면에서 테러자금 수단으로의 활용이 급증하고 있는 실정이다. 이와 같이 가상자산을 이용한 테러 및 범죄의 위협이 점차 커지는 상황에서 국내 법집행기관들은 일반적인 화폐와는 다른 가상자산의 특징으로 인해 수사활동에 어려움을 겪고 있다. 특히 가상자산은 익명성과 가용성, 보안 등의 가상자산의 특징과 불완전한 가상자산거래소의 보안성 등을 이용한 테러수단으로서의 활용이 지속되고 있는 반면, 가상자산을 이용한 테러 등의 범죄를 추적하고 수사하기 위한 법적·제도적 뒷받 침은 미흡한 실정이기 때문이다. 더구나 가상자산은 그 기술적 측면에서 암호해제의 어려움이 존재할 뿐만 아니라 난립하는 거래소들로 인해 해킹 등에 취약하다는 점에서 증거물 오염 가능성이 높아 테 러범죄에 활용된 가상자산에 대한 증거수집과 분석을 위한 디지털포렌식 간 제한사항이 존재한다. 본 연구의 목적은 이러한 현실을 고려하여 가상자산을 이용한 테러범죄 수사간 디지털포렌식 분 야의 개선소요를 도출하고, 이를 보완하기 위한 법적·제도적 개선방안을 제안함으로써 가상자산을 이용한 테러범죄 수사 및 예방에 기여하는 것이다. 이를 위해 연구방법으로 관련 연구논문 등의 문 헌조사와 전문가 집단과의 심층면담을 병행하였으며, 연구를 통해 가상자산의 특성으로 인해 디지털 포렌식 과정에서 다양한 제한사항이 존재한다는 점과 이를 보완하기 위해 법령 및 제도의 개선이 필요함을 확인하였고, 암호해제 및 무결성 인증 시스템 확립, 가상자산 개념 및 압수방법 법제화, 국 제공조수사 및 가치변동 대응 방안과 같은 개선방안을 제안하였다.

영문 초록

Recently, as global attention has been focused on virtual assets, the use of virtual assets in various crimes and terrorism has been on the rise. In recent years, the number of arrests and damages related to virtual assets has more than increased eightfold, and the use of terrorism as a means of funding in terms of international terrorism is rapidly increasing. In this increasing threat of terrorism and crime using virtual assets, domestic law enforcement agencies are having difficulty investigating because of the characteristics of virtual assets different from ordinary currency. In particular, virtual assets continue to be used as a means of terrorism using the characteristics of virtual assets such as anonymity, availability, and security, while legal and institutional support for tracking and investigating crimes such as virtual assets is insufficient. Moreover, virtual assets are not only technically difficult to decrypt, but also vulnerable to hacking due to rampant exchanges, and there are digital forensics restrictions for collecting and analyzing evidence of virtual assets used in terrorist crimes. Considering this reality, this study aims to contribute to the investigation and prevention of terrorist crimes using virtual assets by deriving the need for improvement in digital forensics and proposing legal and institutional improvements to supplement them. To this end, we conducted in-depth research on related research papers and interviews with a group of experts, identified that various limitations exist in the digital forensics process due to the nature of virtual assets, and proposed improvements such as the establishment of a cryptographic and integrity certification system, legislation of virtual asset concepts and confiscation methods, international collaboration investigations and measures to respond to changes in value.
