국문 초록

이 연구의 목적은 산업보안범죄의 유형별 실태를 분석하고 그 실태 속에 내포된 함의와 시사점을 도출함으로써 기업들의 보안관리 역량강화에 필요한 방안을 제시하기 위한 것이다. 이러한 목적을 달성하기 위해 최근 3년 6개월간 전국의 법원에서 선고된 영업비밀보호법 위반 사건에 대한 제1심 판결문을 기초로 실태를 분석하고 시사점을 도출하였다. 이 연구의 분석 결과 및 시사점을 요약하면 다음과 같다. 첫째, 피해회사의 내부자가 연루된 경우가 전체의 90%를 상회하고 있다. 이는 산업보안범죄의 패 러다임이 완전히 달라졌음을 의미한다. 그럼에도 불구하고 내부자-외부자간 공동정범 역시 높은 비 중을 차지하고 있다는 것은 산업보안범죄에 있어서 경쟁업체들이 기존의 직접적인 침투를 지양하고 피해회사의 내부자를 활용하는 식의 우회적인 방법을 선호하고 있음을 확인할 수 있었다. 둘째, 내부 유출이 주로 중하위직 일반직원들에 의해 이루어지고 있다. 기업들은 업무기여도에 상 응하지 않는 불합리한 보상체계가 일반직원들로 하여금 부정적인 정서를 유발하며, 이는 곧 경쟁업체의 입장에서 매력적인 표적이 된다는 점을 유념하여 사내 보상체계 개선을 위해 노력해야 하겠다. 셋째, 내부유출자의 상당수는 회사의 정보를 자신의 사업에 활용하거나 이직에 활용하려는 의도를 가지고 범죄를 저질렀다. 이러한 분석 결과를 통해 직원의 일탈 징후나 이상행동에 대한 기업의 감지 역량이 현저히 낮음을 알 수 있었다. 그러나 직원에 대한 회사의 과도한 감시체제는 직원에 대 한 무관심보다 더 위험할 수 있다. 정보보안 전문인력의 전략적 양성 및 활용도 제고가 긴요하다.

영문 초록

The purpose of this study is to present measures necessary for strengthening security management capabilities by analyzing the current status of industrial security crimes and deriving implications implied in them. To achieve this purpose, the court judgements on the cases of infringement of trade secrets sentenced in South Korea were collected as subjects of analysis. The analysis results and implications of this study are summarized as follows. First, more than 90% of the cases involve insiders of the damaged company. This means that the paradigm of industrial security crime has changed completely. Nevertheless, the fact that insider collaboration with outsiders also accounts for a high proportion shows that competitors avoid the existing direct penetration of industrial security crimes and prefer indirect methods. Second, internal leaks are mainly made by mid- to low-level employees. Companies should understand that unreasonable compensation schemes that do not correspond to work contributions cause employees to feel negatively against the company. It should also be noted that these employees are soon attractive targets for competitors. Third, many insiders who committed industrial security crimes intended to use trade secrets for their own businesses or for turnover. These analyses showed that companies' ability to detect signals of deviant behavior of their employees was significantly poor. Therefore, it is necessary to strategically train and widely utilize experts in industrial security.
