산업스파이 활동과 탐정의 역할

국문 초록

이 연구의 목적은 중국과 같은 개발도상국으로부터 위협받고 있는 우리나라의 국가핵심기술을 지키기 위해 국가 공권력만으로는 한계가 존재함으로 따라 해외주요국가에서 활용되고 있는 탐정의 역할에 관하여 탐색해보고자 하였다. 아울러 우리나라에서 탐정은 지난 20년간 경찰청과 법무부의 대립으로 인해 제도의 입법화에 어려움이 있었으나 지난 2018년 헌법재판소의 판시와 신용정보의 이용 및보호에 관한 법률 소관청인 금융위원회와 경찰청의 행정해석 등으로 새로운 법률 제정이나 현행법개정 없이도 사생활 조사에 포함되지 않는 탐정 활동은 가능하게 되었다는 점에서 그 의의가 있다. 이 연구를 수행하기 위해 질적연구와 양적연구를 통합하여 수행하였다. 먼저 질적자료처리는 구미지역 민간경비업체 중 산업기술유출 단속업무 경험을 보유한 5개소를 무작위로 선정하였다. 이 중탐정에 대한 이해도와 최소 10년 이상의 근무경력을 기준으로 표집하고 반구조화된 면담기법(Semi In-Depth Interview)을 수행하였고 질문에 대한 10-15회 반복된 면담으로 자료의 포화도(Saturation) 를 얻을 수 있었다. 다음으로 양적자료 처리는 설문에 대한 결과를 근거로 신뢰도를 검증하고Cronbach's α 계수를 이용하여 신뢰도를 분석하였고 SPSS 23.0 Program으로 빈도분석(Frequency Analysis), t-test, ANOVA 분석을 실시하였다. 연구결과는 먼저 질적분석의 결과 첨단 산업기술 해외 유출 차단 활동, 연구개발 성과물 및 연구데이터 보호 활동, 산업보안 교육 및 컨설팅 활동, 지적재산권 침해 관련 대응 활동, 사내의 산업스파이 신고 및 상담활동을 범주화되었으며, 위의 범주화 자료를 설문문항으로 한 양적분석의 결과 산업스파이 활동에서 탐정의 역할을 양적으로 성별, 연령, 학력, 근무경력, 공직생활경험, 산업기술유출사건적발경험에 따라 확인한 결과 통계적으로 유의한 차이는 없는 것으로 나타났다. 이에 근거한 이 연구의 결론은 이 연구에서 사용된 문항이 산업스파이 활동에서 탐정의 주요 업무영역임을 확인하는데 무리가 없는 것으로 판단되었다.

영문 초록

The purpose of this study was to explore the role of private investigators being used in major overseas countries as national authority alone has limitations to protect Korea's core technologies threatened by developing countries such as China. In addition, in Korea, private investigators have had difficulties in legislating the system due to the confrontation between the National Police Agency and the Ministry of Justice over the past 20 years, but it is meaningful in that they have been able to conduct detective activities that are not included in the investigation of privacy without enacting new laws or revising the current law due to the judgment of the Constitutional Court of Korea in 2018 and the administrative interpretation of the Financial Services Commission and the National Police Agency, which are the jurisdiction over the Credit Information Act. In order to carry out this study, qualitative and quantitative studies were integrated. First, for the qualitative data processing, five private security companies, located in Gumi, Korea, with experience in controlling industrial technology leakage were randomly selected. Among them, samples were gathered based on the understanding of private investigators and the experience of at least 10 years, and semi in-depth interviews were conducted. Data saturation was obtained through 10-15 repeated interviews on the questions. For the quantitative data processing, the reliability was verified based on the results of the survey and was analyzed using the Cronbach's α coefficient, frequency analysis, t-test, and ANOVA were performed with the SPSS 23.0. The findings are as follows. Qualitative analysis has categorized high-tech overseas leakage prevention activities, R&D outcomes and research data protection activities, industrial security education and consulting activities, intellectual property rights infringement-related response activities, in-house industrial espionage reporting, and counseling activities, and quantitative analysis using the above categorization data as a questionnaire confirmed that there were no statistically significant differences in regards to the role of private investigators in industrial espionage activities according to gender, age, academic background, work experience, and statistical experience in industrial technology leakage. Based on this, the conclusion of this study was judged to be reasonable to confirm that the questions used in this study were the main areas of detective work in industrial espionage.
