학교폭력예방 및 선도정책 효과증진을 위한 현상학적 연구: 개정된 학교폭력 심의위원회를 중심으로

국문 초록

이 연구는 개정된 학교폭력 심의위원회와 이전의 학교폭력 자치위원회의 운영과 비교하여 개선된점과 심의위원회의 의견을 통하여 학교폭력 예방 및 선도를 위한 개선방안을 연구하는 것이 목적이다. 연구방법은 인천시의 학교폭력 심의위원을 대상으로 질적 연구의 방법 중 현상학적 연구를 통하여 분석하였다. 분석결과는 다음과 같다. 첫째, 위원회 활동의 객관성과 공정성에 대한 신뢰가 높아졌다. 이전의 자치위원회의 활동에 대한객관성과 공정성에 대한 문제를 일부 해결하였다는 의미로 나타났다. 둘째, 법 개정 이후 당사자 간의 합의한 경우 학교장에게 종결 권한을 주었고, 학교장의 합의 종용 남용에 대한 대책이 미비한 것으로 나타났다. 셋째, 위원회에 출석한 학생은 심리 후 참고인만 별도로 지원이 가능하여 심리중변호인의 지원이 필요한 것으로 나타났다. 넷째, 위원회는 학교폭력예방을 위한 처분보다는 가해자에 대한 반성을 요구하는 처분이 대부분으로 예방을 위한 대책이 필요한 것으로 나타났다. 이에 대한 대책으로 학교장의 종결권에 대한 통제, 학생 심리 진행시 국선변호인 지원, 피해학생에게 의무적 심리치료지원, 학교폭력 전문교육기관 설립과 전문가 선발·투입을 제언하였다.

영문 초록

The purpose of this study is to study the improvement measures for the prevention and guidance of school violence through the opinions of the review committee and the improvement of the operation of the revised school violence review committee and the previous school violence self-governing committee. The research method was analyzed through a phenomenological study of qualitative research methods among school violence review committee members in Incheon Metropolitan City. The analysis results are as follows. First, confidence in the objectivity and fairness of the committee's activities has been increased. It was shown that some of the problems regarding objectivity and fairness of previous autonomous committees were solved. Second, after the revision of the law, the principal was given the authority to terminate the agreement between the parties, and the measures for the principal's abuse of the agreement were insufficient. Third, students who attended the committee were found to need support from an attorney during the hearing because only the reference person can support the students after the hearing. Fourth, most of the cases in which the Commission demands remorse for the perpetrators rather than for the prevention of school violence therefore It has been shown that measures for prevention are needed. As a countermeasure, it proposed controlling the principal's right to close the school, supporting public defenders when conducting student psychology, providing compulsory psychological treatment to victims, establishing a specialized school violence education institution, and selecting and injecting experts.
