국문 초록

The appropriate connection clause in the newly amended Civil Procedure Law of the People’s Republic of China, is a moderate expansion of international civil litigation jurisdiction. Under the clause, whether the site of domicile of plaintiff can be get rid of the suspicious for excessive jurisdiction needs to be discussed in different types of cases. With the systematic logic of the clause, the importance of plaintiff’s domicile site varies from case to case. In addition, factors such as legal interest, litigation cost, equity of tow arms should be taken into account. The application of the site should be motivated by the fact that the site is more easily determined or just for obtaining international civil litigation jurisdiction. Therefore, in judicial practice, judges should be cautious in applying and strengthening the doctrinal justification of the “appropriate connection” point of jurisdiction.

영문 초록

新修订的《民事诉讼法》规定的“适当联系”条款，是对人民法院国际民事管辖权的适度扩张。在“适当联系”条款之下，原告住所地是否能够摆脱过度管辖之嫌具有合理性需要结合不同案件类型进行讨论。在“适当联系”条款的体系管辖逻辑之下，原告住所地管辖点在不同类型的案件中具有不同的重要程度。除此之外，还应当考虑法律利益、诉讼经济、两造平等等因素。原告住所地管辖点的适用应当出于原告住所地更容易确定或单纯为争夺国际民事管辖权。因此，法官在司法实践中，应当审慎适用并加强对“适当联系”管辖点的说理论证。
