국문 초록

The implementation of the Constitution is an important part of the construction of a socialist rule of law state, and the record review system is an organic component of the implementation of the Constitution. Record review is a specific legal system in which the organ with authority reports the normative documents it has formulated to the relevant organ provided for by law for the record in accordance with the statutory procedures, and the statutory organ accepting the record files and reviews the normative document. The filing and review system has gradually matured through decades of development under the rule of law in China, and has become a legal system that can effectively supervise local legislation with great Chinese characteristics. However, despite the vibrant state of the filing and review system, the filing and review of the laws of the Special Administrative Regions (SARs) has shown an almost opposite development compared to the filing and review of other laws in the Mainland. The Hong Kong Basic Law and the Macao Basic Law both provide for the filing review system, basically forming the filing review system under the background of the one country, two systems system, but the practice of filing review of the laws of the Special Administrative Regions (SARs) reflects the inadequacy of the Basic Law in respect of the filing review system of the laws of the SARs. In the face of this situation, combining the great concept of ‘one country, two systems’ with the special social and legal status of the SAR, it is of great significance to further standardise the system of filing and reviewing the laws of the SAR, and to clarify the process and public procedures in order to improve the system.

영문 초록

宪法的实施是建设社会主义法治国家的重要组成部分，备案审查制度又是宪法实施的有机构成。备案审查是有权机关依照法定的程序将其制定的规范性文件报法律规定的有关机关进行备案，接受备案的法定机关对该规范文件进行归档和审查的特定的法律制度。备案审查制度经过几十年的发展在中国法治环境下逐渐成熟，成为极具中国特色可以对地方立法进行有效监督的法律制度。但是，尽管备案审查制度呈现一个生机勃勃的样态，特别行政区法律的备案审查相比内地其他法律的备案审查却表现出一个几乎相反的发展情形。《香港基本法》与《澳门基本法》对于备案审查制度均进行了规定，基本形成了一国两制制度底色下的备案审查制度，但是特别行政区的法律的备案审查实践却反映出基本法对于特别行政区法律的备案审查制度是存在不足的。面对这种情况，厘清特别行政区法律备案审查制度的法律依据及法理基础的理论之上，结合一国两制的伟大构想与特别行政区特殊的社会与法律现状，将特别行政区法律的备案审查制度进一步规范化，明确备案流程及公开程序对于完善该制度具有重要意义。
