数字法治观下反腐败国际追逃机制研究

국문 초록

Under the guidance of the digital rule of law concept, China's rule of law has entered a new stage of development. The academic community has produced different interpretations around the concept of “digital rule of law”, focusing on the field of cross-border corruption governance. In the future, it is necessary to promote the digital construction of the international anti-corruption fugitive mechanism. Based on the characteristics of the digital age, it is proposed that China's international anti-corruption pursuit mechanism should use digital technology as a carrier to promote the top-level design reform of cross-border corruption governance. Three digital technologies should be sorted out: data management platforms for online reporting and information disclosure, tracking and locking in the escape routes and fund flows of corrupt individuals, and their current functional limitations should be analyzed from the perspectives of “domestic international” and “domestic”. In addition, it is advocated that the next step is to strengthen the digital construction of the anti-corruption international fugitive mechanism from three aspects: improving the technical support and supervision guarantee of the digital fugitive platform, strengthening international cooperation and data exchange between regions, and enhancing the incubation cooperation between professional teams and technology enterprises.

영문 초록

数字法治观指引下的法治中国进入新发展阶段，学界围绕“数字法治”的概念产生了不同的解读，聚焦跨境腐败治理领域，未来，推进反腐败国际追逃机制的数字化建设具有必要性。结合数字时代特点，提出我国反腐败国际追逃机制应当以数字化技术为载体，推动跨境腐败治理的顶层设计改革，梳理出线索检举与信息公开的数据管理平台、追踪与锁定贪腐分子逃匿路线与资金流动三种数字技术，并分别从“国内-国际”和“国内”两个视角对其当前的功能局限进行分析。此外，提倡下一步要从完善数字化追逃平台的技术支撑与监督保障、强化区域间国际协作与数据互通、加强专业队伍与科技企业的孵化合作三个方面加强反腐败国际追逃机制的数字化建设。
