국문 초록

The establishment of criminal data exit rules in criminal judicial assistance is of great significance to safeguard national sovereignty, safeguard data security and protect individual rights and interests. However, at present, China’s criminal data exit regulations are still in the stage of “general rule coverage, special rules absence”, which needs to be improved through multiple dimensions such as legislative refinement, international cooperation and technical support. After distinguishing between ordinary data and criminal data, this paper will focus on the relationship between national sovereignty and judicial assistance, data security and data free flow, normal opening and case request involved in criminal data exit in criminal judicial assistance, and innovatively propose the criminal data exit mode with “case request as the main, limited normal opening as the auxiliary”. And build a security assessment dual-track review mechanism.

영문 초록

刑事司法协助中刑事数据出境规则的构建对于维护国家主权、保障数据安全以及保护个人权益具有重要意义。但目前我国刑事数据出境规范尚处于“一般规则覆盖、专门规则缺位”的阶段，需通过立法细化、国际合作及技术保障等多维度完善。本文将在区分普通数据和刑事数据后，聚焦刑事司法协助中刑事数据出境中涉及的国家主权与司法协助、数据安全与数据自由流动、常态开放与个案请求三组关系展开研究，创新性地提出以“个案请求为主、有限常态开放为辅”的刑事数据出境模式，并构建安全评估双轨制审查机制。
