국문 초록

디지털 경제의 정착과 함께 디지털 무역이 기존 상품이나 서비스 무역에 비견할 만한 존재감을 드러내면서 한국과 외국 간 디지털 무역규범체계에 대한 관심과 중요성이 동시에 제고되고 있다. 실제 한국은 FTA를 통해 관련 규범체계를 구축해 나가면서도 별도의 DTA를 활용하여 이를 정책적으로 추가, 보완하고 있다. 당장의 협력 가능성이 큰 EU, 동남아시아 등과 비교했을 때 중남미는 상대적으로 해당 논의에서 소외되고 있으나 해당 대륙이 가지는 디지털 잠재력을 고려하면 규범체계의 검토는 중요하다. 본 연구는 이 지역 국가들과의 모든 RTA 규범을 비교, 분석하였는데 2025년 3월 현재 총 10개 중남미 국가들이 한국과 FTA, DTA를 통해 디지털 무역규범체계를 가지고 있음에도 절반 이상의 국가들과의 규범들은 매우 기본적인 수준에 머물러 있는 것으로 발견된다. 미래 디지털 무역협력의 안정성 강화를 위해 보완 논의가 필요할 수 있다. 이런 관점에서 한-에콰도르 SECA나 칠레가 포함된 DEPA는 완성형에 가까운 디지털 무역규범들을 명문화 해 중남미형 디지털 무역규범의 표준 개발에 큰 시사점을 제시한다. 현재 진행 중인 MERCOSUR와의 FTA협상에도 참고가 될 수 있는 부분이다.

영문 초록

Along with the expansion of digital economy as digital trade has become so important as traditional trades in goods and services, the digital trade regulations between Korea and its other trading partners are paid much more attention than ever before. Factually Korea has not only been utilizing its FTAs to structurize digital trade regulations with others, but also DTAs. Central-South America has clearly not been in the Korea's top-priority in this matter unlike the EU or ASEAN, yet considering the potential they embrace, the review of current digital trade norms between Korea and the continent can hardly be delayed. After reviewing and comparing all the digital trade regulations, as of March, 2025, most of the ten Central-South American FTA and DTA partners of Korea have set up the digital trade rules at a very basic standard. It brings an wake-up call to Korea to further develop the rules for the better stabilization of digital trade between the parties. On the contrary, Ecuador and Chile have built comparatively more complete digital trade environment with Korea through its regional agreements. This could possibly provide meaningful implications to future digital trade negotiations with the region, including the concurrent talks with the MERCOSUR.
