살인범죄 양형요인 성차 연구 : 피해자 남녀 집단 중심으로

국문 초록

이 연구의 목적은 살인범죄자 형량에 있어 피해자 특성의 영향력이 남녀 집단별로 차이가 존재하는지 확인하는 것이다. 이를 위하여 피해자 특성에 따라 양형 차이가 존재할 수 있다고 가정하는 기사도 가설과 갈등이론, 초점관심이론을 기반으로 연구모형을 설계하였다. 연구대상은 2012년 1월부터 2023년 12월까지 서울지역 1심 법원에서 유죄가 선고된 살인혐의 피고인 판결문 232개이다. 분석결과, 피해자 남녀 집단별로 가해자의 형량에 미치는 영향에 차이가 존재하는 것으로 나타났다. 양형기준 내 양형인자를 보면 특별가중인자인 계획 범행과 잔혹 수법은 남녀 피해자 모두 가해자 형량을 늘리는 것으로 나타났다. 하지만, 감경인자 중 피해자 유발은 남성 피해자만 가해자의 형량을 감소시켰다. 자수와 심신미약, 처벌불원은 여성 피해자만 가해자의 형량을 감소시켰다. 가해자와 관계도 여성만 가해자와 관계가 친밀할수록 가해자의 형량이 감소하는 것으로 나타났다. 연구결과를 토대로 정책적 함의를 도출하고, 연구의 한계와 후속 연구의 방향성을 제시하였다.

영문 초록

The purpose of this study was to examine gender differences in the sentences given to convicted homicide offenders in the Seoul District Court, South Korea. The focal concern theory, conflict theory, and chivalry hypothesis were employed to develop the research hypotheses and models. The subjects of this study are 232 cases in which a verdict was imposed between 2012 and December 2023. The cases were limited to those involving a single perpetrator and a single victim. The results of the analysis show that there are differences in the factors that influence the sentencing of homicide offenders based on the victim's gender. The seriousness of the offense, premeditation, and the use of brutal methods all have a significant positive effect on sentencing for both male and female victim groups. However, in cases involving culpable male victim, offenders are less likely to receive severe sentences. Non-support for punishment and self-reporting have a significant negative effect on sentencing, but only for offenders who have killed women. The results also indicate that a closer relationship between the female victim and the offender is associated with less severe sentencing. The implications of these significant findings for the justice system are explored. The limitations of the study are discussed.
