온라인 수색제도의 도입 방향

국문 초록

이 글은 범죄수사에 있어 디지털 정보의 신속하고 정확한 확보가 관건이 되고 있는 현실에서 최근 관심이 점증하고 있는 온라인 수색제도를 그 대상으로 한다. 향후의 형사절차에서 디지털정보의 효율적 확보와 관리를 위한 다양한 법제도적 장치의 마련이 필요하다는 점 또한 이견이 있을 수 없겠지만, 온라인 수색은 광범위하고 강도 높은 기본권 침해의 위험성으로 인하여 이를 본격적으로 도입하기 위해서는 그 허용범위를 비롯한 법률상의 요건을 엄격하게 제한할 필요가 있다. 이러한 온라인 수색제도 도입의 방향을 나름의 방식으로 모색하고자 온라인 수색제도의 의미와 그 도입필요성(Ⅱ), 온라인 수색제도를 이미 도입하고 있는 독일의 입법현황(Ⅲ), 향후 우리 형사절차상 온라인 수색제도의 도입을 위한 방향(Ⅳ) 등을 차례로 살펴보았다. 결론적으로 온라인 수색제도는 유사한 다른 수사수단에 비하여 광범위한 기본권 침해의 가능성을 내포하고 있다는 점에서 그 도입에 대하여는 조심스러운 접근이 필요하지만, 최근 발생하고 있는 범죄의 양상은 온라인 공간으로 깊숙하게 숨어들고 있음이 명확하다는 점에서 특단의 대책으로 온라인 수색을 고려해야만 하는 상황임을 지적하였다. 특히, 온라인 공간의 특성에 따른 증거수집의 어려움은 온라인 수색으로 인한 기본권 침해의 가능성이 현저함에도 이를 도입해야 할 당위성을 어느 정도 제공하고 있다고 보았으며, 온라인 수색의 도입에 따른 기본권 침해의 가능성을 최소화하기 위하여 독일에서 온라인 수색제도가 도입되는 과정에서 검토된 사항들과 현행 독일 형사소송법에 도입된 온라인 수색제도의 실체적·절차적 요건을 참고할 것을 제안하였다. 이에 따라 온라인 수색을 도입하기 위한 전제로서 온라인 수색의 개념범위를 명확히 하고, 온라인 수색의 허용대상범죄를 아동·청소년을 대상으로 하는 온라인 공간에서의 성폭력범죄 등으로 제한하고, 온라인 수색의 허용요건을 실체적·절차적으로 엄격하게 설정하는 노력이 선행되어야 함을 지적하였다. 또한 온라인 수색으로 인한 사생활 침해를 최소화하기 위한 안전장치로서 수집된 데이터의 선별·저장·관리를 담당하는 제3의 독립된 기관을 설립할 필요가 있음을 강조하였다.

영문 초록

This article is about online search system, which has been receiving increasing attention recently in the current reality where rapid and accurate acquisition of digital information is becoming the key in criminal investigation. There can be no disagreement that various legal and institutional devices are necessary for efficient acquisition and management of digital information in future criminal procedures, but online search has a risk of infringement of fundamental rights in a wide range and intensity, so in order to fully introduce it, it is necessary to strictly limit the legal requirements including the scope of permission. In order to seek the direction of introduction of this online search system in its own way, we looked at the meaning of the online search system and the necessity of its introduction (Ⅱ), the legislative status of Germany, which has already introduced the online search system (Ⅲ), and the direction for introducing the online search system in Korea's criminal procedures in the future (Ⅳ). In conclusion, the online search system has the potential for a wide range of violations of fundamental rights compared to other similar investigative methods, so it is necessary to approach its introduction cautiously. However, it is clear that the recent pattern of crimes is deeply hidden in online spaces, so it has reached a point where it is necessary to consider online searches as a special measure. In particular, it is seen that the difficulty of collecting evidence due to the characteristics of online spaces provides a certain degree of legitimacy for introducing it, despite the high possibility of violations of fundamental rights due to online searches. In order to minimize the possibility of violations of fundamental rights due to the introduction of online searches, it is suggested to refer to the matters reviewed during the introduction of the online search system in Germany and the substantive and procedural requirements of the online search system introduced in the current German criminal procedure law. Accordingly, as a prerequisite for introducing online search, it was pointed out that efforts should be made to clarify the scope of the concept of online search, limit the crimes subject to online search to sexual violence against children and adolescents in online spaces, and strictly establish the requirements for allowing online search in terms of substance and procedure. In addition, it was emphasized that it is necessary to establish a third independent organization in charge of selecting, storing, and managing collected data as a safety device to minimize privacy infringement due to online search.
