산업기술 유출범죄 대응역량 강화방안 고찰

국문 초록

세계 각국은 첨단기술의 해외유출을 방지하기 위해서 노력하고 있다. 우리나라 역시 주력 산업인 반도체, 이차전지, 자율자동차 등의 국가 핵심기술의 해외유출을 차단하고자 산업통상자원부, 국정원, 관세청, 대검찰청, 경찰청 등 관련 부처가 대책을 마련하고 있지만, 해외유출 범죄가 빈번하게 발생하고 있다. 우리나라에서 국가 핵심기술유출 범죄가 반복되는 것은 법관이 산업기술유출 범죄를 판결할 때, 대부분 산업기술보호법, 부정경쟁방지법 등의 처벌 규정보다 낮은 ‘지식재산권범죄 양형기준’인 ‘영업비밀 침해행위’를 적용함으로써 법정형 대비 형량이 낮기 때문이다. 그리고 산업기술 유출범죄는 일반적인 생계형 절도죄와 달리 금전적 이득을 목적으로 한 화이트칼라 직업군에서 자행한 초범이 대다수로 인해 감형 요인으로 작용하고, 재범 가능성은 낮은 편에 있다. 이 글은 산업기술유출 범죄의 근본적인 차단을 위해서 양형기준의 합리적 판단, 산업기술 피해액 산출 전문가 확보와 표준 시스템 마련, 전문기구 설립, 수사 전문인력의 확보와 수사기법 전문화, 유관기관과의 상호협력, 법·제도 개선 노력 등의 개선방안을 제언하였다.

영문 초록

Countries around the world are trying to prevent the outflow of high-tech technology. In Korea, related ministries such as the Ministry of Trade, Industry and Energy, National Intelligence Service, Korea Customs Service, Supreme Prosecutors' Office, and National Police Agency are preparing measures to block overseas outflow of key industries such as semiconductors, secondary batteries, and autonomous vehicles. However, crimes against the outflow of industrial technology are frequently occurring. Repeated crimes of national core technology leakage in Korea apply the “trade secret infringement” of the “Intellectual Property Crime Sentencing Standards” lower than the punishment regulations of the Industrial Technology Protection Act and the Unfair Competition Prevention Act. In other words, the sentence is lower than the legal sentence. In addition, industrial technology leakage crimes, unlike general theft crimes, are mostly first-time offenders committed by white-collar workers for the purpose of financial gain, so they serve as a factor in reducing sentences, and the likelihood of recidivism is low. Therefore, this article suggested policy alternatives such as rational judgment of sentencing standards, securing experts in calculating industrial technology damage and establishing a standard system, establishing specialized organizations, securing investigative experts, specializing in investigative techniques, mutual cooperation with related organizations, and efforts to improve laws and systems to fundamentally block industrial technology leakage crimes.
