이상동기 범죄의 유형과 대응방안에 관한 연구

국문 초록

이상동기 범죄는 대상이 특정되어 있지 않고 범행이 잔혹하기 때문에 국민들은 공포에 빠지기 쉽다. 또한 이상동기 범죄의 원인은 외부에 있는 것이 아니라 내부의 분노를 표출하는 것이기 때문에 예방이 어렵다. 따라서 이상동기 범죄에 대한 명확한 규명을 통하여 유형별로 그에 맞는 대응방안을 모색할 필요가 있다. 이상동기 범죄는 분노 발생의 원인에 따라 정신질환형, 현실불만형, 만성분노형, 약물·게임 등 중독형, 반사회성 성격장애형 으로 나누어 볼 수 있다. 이러한 이상동기 범죄에 대처하기 위해서는 첫째, 정신질환형 이상동기 범죄의 경우에는 정신질환자에 대한 가족과 국가차원의 치료와 보호가 필요하다. 특히 국가가 전문 인력과 전담기구를 만들어서 국가의 부담으로 치료해 줄 수 있는 시스템을 갖추어야 할 것이다. 둘째, 현실불만형 이상동기 범죄의 경우에는 인지-행동 치료 프로그램이나 멘토 프로그램 등을 통해 직장 생활 및 정상적인 가정을 꾸리기 위한 사회화 훈련과 일종의 사회적 유대관계를 형성해 줄 필요가 있다. 셋째, 만성분노형 이상동기범죄를 예방하기 위해서는 분노 조절 및 대처기술을 강화할 필요가 있겠다. 넷째, 알코올이나 마약 등 중독범죄에 있어서 단속과 처벌 보다는 예방교육과 치료보호가 필요할 것이다. 또한 게임중독 등에 의한 이상동기 범죄를 저지르지 않게 하기 위해서는 가족과 소통이나 전문적인 면담을 통하여 게임 등에 중독되지 않도록 관리할 필요가 있을 것이다. 다섯째, 반사회성 성격장애형 이상동기 범죄에 대처하기 위해서는 우리나라의 형사절차에서도 심리평가와 진단이 필요하다고 할 것이다.

영문 초록

Because abnormally motivated crimes do not have a specific target and the crimes are brutal, it is easy for the public to fall into fear. In addition, the cause of abnormally motivated crimes is not external, but rather an expression of internal anger, making it difficult to prevent. Therefore, it is necessary to clearly identify abnormally motivated crimes and find appropriate response measures for each type. Abnormally motivated crimes can be divided into mental illness type, reality dissatisfaction type, chronic anger type, addiction type such as drugs and games, and antisocial personality disorder type depending on the cause of anger. In order to deal with these abnormally motivated crimes, first, in the case of mentally ill-type abnormally motivated crimes, treatment and protection at the family and national level for the mentally ill is necessary. In particular, the state should establish a system that can provide treatment at the state's expense by creating specialized personnel and a dedicated organization. Second, in the case of abnormally motivated crimes of the type of dissatisfaction with reality, it is necessary to provide socialization training and a kind of social bond for working life and raising a normal family through cognitive-behavioral therapy programs or mentor programs. Third, in order to prevent chronic anger-type abnormally motivated crimes, it is necessary to strengthen anger management and coping skills. Fourth, prevention education and treatment and protection will be needed rather than crackdown and punishment for addiction crimes such as alcohol or drugs. In addition, in order to prevent people from committing abnormally motivated crimes due to game addiction, etc., it will be necessary to manage them so that they do not become addicted to games, etc. through communication with family or professional interviews. Fifth, in order to deal with abnormally motivated crimes of the antisocial personality disorder type, psychological evaluation and diagnosis are necessary in our country's criminal procedures.
