자주통일과 ‘한국 주도’의 법적 논리

국문 초록

남북통일은 외세의 부당한 개입 없이 자주적으로 이루어져야 한다. 또한 민족사적 정통성 및 국가적 법통성을 갖는 한국이 남북통일을 주도하는 것이 타당하다. 특히 북한의 급변사태 발생 시 한국은 북한지역의 관할권 확보 등 핵심적 역할을 하는 것이 바람직하다. 자주적 통일을 위해 한국은 국제사회에서 남․북 특수관계론과 함께 민족자결과 관련된 남․북의 관행(정전협정에 의해 설정된 군사분계선의 비국경선화, 유엔 가입의 잠정적 조치성 등)을 주장함으로써 남북통일 지지 세력을 늘려가는 한편, ‘한반도 내 2국가론’의 확산을 배격해야 한다. 이와 관련해서 1943년의 카이로선언과 한반도에서 통일·독립·민주정부 수립을 권고한 1947년의 유엔 총회 결의 등 권위 있는 국제문서를 적극 원용할 필요가 있다.

영문 초록

Korean unification must be accomplished independently without undue interference of outside influence. It is proper the Republic of Korea(ROK) with historical orthodoxy and legal legitimacy play a leading role in pursuing national unification. Moreover it is true with North Korean contingencies. For the autonomous unification, ROK should expand unification-supporting powers by emphasizing a logic of Inter-Korean special relations within a divided state, and South-North Korean practices concerning national self-determination in international society. On the other hand, it should prevent a spreading of “two states on the Korean peninsula” theory all over the world. In relation to this matter, we could pro-actively invoke authoritative international instruments including Cairo Declaration of 1943, the 1947 U.N. General Assembly resolution on the Problem of Independence of Korea recommending the establishment of a unified, independent and democratic government in all Korea and the like.
