국문 초록

미국을 비롯한 선진국은 급변하는 금융환경변화와 각종 규제완화 등에 보다 효율적으로 대처하기 위하여 연금설계 및 운용의 탄력화를 적극 도모, 연금재정의 안정화를 기하고 있으며 또한 각종 지급보증제도를 지속적으로 정비·보완하고 있다. 그러나 선진국과는 달리 우리나라의 경우는 지급보증제도가 법적으로나 제도적으로 거의 개선되고 있지 않아 실질적으로 종업원에 대한 기업연금 지급보증이 매우 미흡한 실정이라 할 수 있다. 따라서 지급보증제도의 개선을 위하여 모기업이 도산하는 경우, 연금자산운용의 오류 및 실패 등으로 연금재정이 악화되는 경우, 연금 수탁기관이 도산된 경우 등으로 구분하여 연금정책적 차원에서 적극 검토할 필요가 있다. 이 경우 선진제도의 단순한 모방과 도입이 아닌 우리나라 특성과 여건에 부합하도록 기업연금 지급보증제도가 개선될 필요가 있다. 이를 위해 본 고는 미국, 일본, 영국의 기업연금 지급보증제도 내용 및 특징을 상호 비교 분석해 본 후에 법적·제도적 차원에서 적용 가능한 기업연금 지급보증 제도의 개선방안을 체계적으로 제시하고자 하였다.

영문 초록

Unlike advanced countries, we have not nearly established the system for guarantee a payment in the corporate pension. Therefore, we can say that it is not enough to guarantee employee payment of the corporate pension. Accordingly, in order to improve the system for guarantee of payment, it is necessary to examine the system for guarantee of payment in the corporate pension positively in terms of policy for pension so that we can provide against failure of parent companies, financial trouble of the corporate pension fund, and failure of the corporate pension trustee companies and so forth. To this end, it is necessary to systematically probe into ways to improve the system for guarantee of payment in the corporate pension which is not a mere imitation or introduction of systems in advanced countries but suitable to the characteristic and situation in this country. This paper compares the contents and characteristic of system for guarantee of payment in U.S., Japan, United Kingdom and intends to systematically present ways to improve the system for guarantee of payment in the corporate pension.
