국문 초록

본 논문에서는 최근 WTO 분쟁제도의 활용이 급증한 인도네시아의 분쟁에 초점을 맞추어 그현황과 주요 제소, 피소사례에 대한 법적쟁점 및 판결내용을 살펴보았다. 또한 이를 토대로인도네시아의 WTO 분쟁이 갖는 특성과 통상정책과의 관련성에 대해 분석하였다. 인도네시아의 WTO 분쟁은 수출주도형 성장전략과 보호무역 정책의 동시적 발현이라는 인도네시아의 정책적 특수성에 기인하여 발생, 증가하는 것을 알 수 있다. 특히 2014년 민족주의 성향이 강한 조꼬위 정부의 출범 이후, 인도네시아는 자원민족주의 노선을 강화하고 있고 외국인투자에 대한 자유주의적 규제완화 정책을 실시하는 한편 반시장적이고 보호주의적 규제를 동시에시행하고 있다는 점에서 인도네시아 관련 WTO 분쟁은 지속적으로 증가될 가능성이 큰 것으로 보인다. 따라서 아세안경제공동체출범 등으로 한층 증가될 것으로 예상되는 인도네시아와의 무역에 보다 효과적으로 대응하기 위해 향후 발생할 수 있는 WTO 분쟁 등 무역마찰의 여지를 최소화기 위한 정책적 필요와 노력이 요구된다.

영문 초록

This study analyzes the current state of WTO trade disputes especially focusing on the disputes of Indonesia, where the use of the WTO dispute resolution procedures has increased rapidly. It will also examine the legal issues and judgments of major cases involving Indonesia, analyzing the economic and political peculiarities that have led to an upsurge in Indonesian disputes. This increase in the Indonesian disputes can be attributed to Indonesia’s distinct national characteristics which enact the contradictory policies of export led growth and protectionist trade. The increased export of manufactured goods emanating from the implementation of an export-oriented policy has a direct correlation to the increase in the number of cases filed with the WTO. Therefore, Korean government and firms need to monitor continuously the ever changing Indonesian domestic laws and regulations to prevent damages caused by disputes and avoid unnecessary conflict in the future.
