장애인 가족지원에 관한 법적 고찰

국문 초록

장애인가족은 일반가족과 비교할 때 가족스트레스가 상대적으로 커서 심할 경우 가족동반자살과 같은 사회적 문제를 야기하기도 한다. 이런 점에서 장애인가족 지원은 가족구조를 강화하고 유지하기 위해서 정부차원의 체계적인 지원이 필요한 영역이다. 본 연구는 이러한 문제인식을 갖고 장애인가족에 대한 정부차원의 지원내용을 살펴보기 위해서, 먼저 가족지원 및 장애인관련 법률에서 규정한 장애인 가족지원에 대한 조항을 살펴보았다. 또한 이와 연계하여 충청남도 및 도내 4개 시·군의 조례를 비교 분석하였다. 내용을 요약하면 장애인가족 지원에 관한 내용은 4개 법률에서 규정하고 있으며 장애인복지법에서 가장 포괄적으로 규정하고 있었다. 또한 가족상담과 휴식지원을 가장 필수적인 지원으로 규정하고 있었다. 한편 충청남도 및 도내 4개 시·군에 장애인가족지원센터가 설치되어 있으나 조례는 충청남도 및 3개 시·군만 제정되어 있었고, 조례명칭 및 지원내용도 서로 차이점이 있었다. 따라서 조례의 제정 및 개정을 통해 장애인가족의 스트레스를 관리하고 가족건강성을 증진할 수 있도록 노력하여야 한다.

영문 초록

Families with disabilities have relatively large family stresses compared to ordinary families, which can cause social problems such as suicide of their families. In this respect, family support for the disabled is an area that requires systematic support at the governmental level to strengthen and maintain the family structure. This study took this perception of the problem and looked at government-level support for disabled families. First, we looked at the provision of family support for the disabled as stipulated in the Family Support and Disabled Person Act. In addition, the ordinance of Chungcheongnam-do and four cities and counties in the province were compared and analyzed. To sum up these details, the four laws provided for support for families with disabilities and provided the most comprehensive in Welfare Low with Disabilites. In addition, family counseling and rest support were provided as the most essential support. Meanwhile, Chungcheongnam-do and four cities and counties had support centers for families with disabilities. However the ordinance was enacted only in Chungcheongnam-do and three cities and counties. Also, the name of the ordinance and the details of the support were different. Therefore efforts should be made to manage the stress of families with disabilities and to promote family health through the enactment and revision of ordinances.
