탐정의 직업윤리에 관한 고찰

국문 초록

본 연구는 한국 탐정의 직업윤리를 고찰하기 위하여 외국의 탐정협회 윤리강령 내용을 분석하고 이를 기초로 탐정의 직업윤리에 대한 시사점을 제시하고자 하였다. 첫째, 품위유지의무이다. 이는 탐정이 직무를 수행함에 있어서 또는 직무를 수행하는 과정에서 발생될 수 있는 품위손상행위는 직무수행 중 법률의 위반, 정보나 그 지위를 이용하여 부당한 이익을 취하는 행위 등이라고 할 수 있다. 둘째, 비밀유지의무이다. 탐정이 그 직무상 알게 된 고객의 비밀을 누설하여 고객에게 피해를 주는 행위이다. 다만 특별한 규정이 있는 경우는 예외이다. 셋째, 이익충돌방지의무이다. 영업상 이해관계가 충돌하는 경우 업무수임은 수락하지 않아야 한다. 넷째, 정직 및 진실유지의 의무이다. 모든 사업거래(수임료) 및 행동에 있어서 정직하게 행동해야 한다. 다섯째, 설명 및 통보의무이다. 불법이나 비윤리적 행위에 대해서는 고객에게 알리고 법률에 따라서는 법집행기관 또는 기타 정부기관에 통보해야 한다. 여섯째, 지속적인 능력개발의무이다. 탐정은 최상의 서비스를 제공하기 위하여 지속적인 능력개발을 수행하여야 한다.

영문 초록

This study analyzed the contents of the ethics code of the foreign detective association in order to examine the work ethic of Korean private investigator, and based on this research, suggested implications for the work ethic of private investigator. First, it is a duty to maintain dignity. This can be said to be a violation of the law during the performance of the duties of a private investigator, and an act of taking undue profits by using information or its status. Second, it is a duty to keep secrets. The private investigator job is to reveal the customer s secret and harm the customer. However, the exception is when there are special provisions. Third, it is a duty to prevent conflicts of interest. In the event of a conflict of business interests, the performance charge should not be accepted. Fourth, it is a duty of honesty and truthfulness. Honest it was necessary to act in all business transactions (hundreds of thousands of dollars in fees) and behavior. Fifth, it is a duty to explain and notify. Any illegal or unethical acts shall be notified to customers and notified to law enforcement or other government agencies in accordance with law. Sixth, it is a continuing capacity development obligation. private investigator should carry out continuous capability development to provide the best service.
