국문 초록

헤어진 연인에게 보복하기 위해 유포하는 성적 콘텐츠를 뜻하는 리벤지 포르노 , 보복성 음란물 , ‘비동의 성적 동영상 유포’, ‘개인 간 성적영상물’ 등의 디지털 성범죄가 급격히 증가하였다. 사회의 심각한 문제로 대두되면서 다양한 근절대책을 발표하고 법제도들도 제정되었지만 비동의 성적동영상 유포범죄가 근절되지 못하고 지속적인 증가 추세에 있다. 이에 본 연구에서는 현황과 사례를 분석하여 정책적 대안을 모색하고 제시하는 것에 연구의 목적을 두었다. 본 연구를 위해 비동의 성적동영상 관련 기사 등 최근 3년 동안의 공식통계와 기사를 분석하였다. 분석결과 다양한 형태와 수단을 통해 비동의 성적동영상이 유포되고 있으며, 피해자는 피해사실을 인지하지 못하는 경우가 많았다. 더불어 사이버 세계에서 유포되는 특징이 있어 국제공조수사가 절실했으며, 법률적 처벌만으로 보복을 위한 성적동영상 유포를 근절하는데 한계를 가지고 있었다. 따라서 성을 소비하는 문화 자체를 개선하는 정책적인 방안을 제시하였다.

영문 초록

The digital sexual crime of ‘revenge porno’, ‘reprisal pornographic material’ and ‘non-consent dissemination crime of sexual video’, etc. meaning on spreading sexual contents to retaliate against a broken lover has been increased rapidly. Even though the diverse eradication measure has been announced and laws and systems have occurred as it has emerged as the serious social problem, the non-consent dissemination crime of sexual video cannot be eradicated and is in the continuous increasing trend. Hence, the purpose of research has been placed in seeking for and proposing the policy alternative by analyzing the current status and examples. The official statistics and articles for recent 3 years in relation to the non-consent sexual video have been analyzed for this research. As a result of analysis, the non-consent sexual video has been disseminated through the diverse form and means, there have been many cases that the victim cannot recognize the fact of damage. Together, the international investigation of cooperation was urgently needed as it had the characteristic to be disseminated in the cyber world; it had the limit in eradicating the dissemination of sexual video for the retaliation with the legal punishment only. Accordingly, the policy measure improving the culture itself consuming the sex has been proposed.
