의료시설 내 폭력범죄예방을 위한 청원경찰법 개정안 등에 관한 비판적 검토

국문 초록

의료시설에 폭력행위를 비롯한 강력범죄가 심화일로에 있다. 이에 대한 문제적 인식이 확대되면서 법률 개정을 통한 보완방안에 대한 구체적 논의가 이루어지고 있다. 여기에 해당하는 개별법규에는 청원경찰법, 경비업법, 응급의료에 관한 법률의 개정안이 있다. 본 연구는 이러한 개정안들의 개정내용을 비판적으로 고찰하고 세 가지 측면에서 개선사항을 제안하였다. 첫째, 개정 법률안이 논의하고 있는 청원경찰과 특수경비원 배치안은 재고가 필요하다. 법률안의 내용은 형평성을 위배하는 것일 수 있다. 의료기관에 특수경비원을 운영하는 방안도 본래 특수경비원의 운영목적을 고려하여 적정성 검토가 선행되어야 할 것이다. 둘째, 의료시설의 계약경비 시스템을 보완하는 방안을 개정안에 반영해야 한다. 경비근무자에게 범죄예방 임무에 전념할 수 있는 내규를 제정하고 준수하도록 해야 한다. 개정 법률안의 내용으로 국가와 지자체가 경비비를 지원하게 된다면 의료시설 경비원의 근무를 명확히 하고 계약경비업체가 변경되어도 경비원의 고용승계가 지속되도록 관리해야 할 것이다. 셋째, 범죄예방 디자인을 확충하고 평가방식을 통한 인증제를 제도화해야 한다. 비상벨 등의 설치에 있어서는 개별 의료시설 현장의 적합성 등을 신중하게 고려해야 한다. 나아가 미국의 산업안전보건의 사례 등을 분석하여 셉티드 전략을 수립해야 할 것이다.

영문 초록

Violent crimes are increasing in medical facilities. The incidence of violent crimes in the medical field has been a factor in weakening medical service. As a result, legislative discussions began. Applicable individual legislation includes amendments to the Policeman on the Special Guard Assignment Law, Security Business, and Emergency Medical Act. First, the police plan needs to be reconsidered in the revised law. The text of the bill violates equity. The operation of special guards at medical institutions should be reviewed to meet the original purpose of the operation. Second, the amendment should cover the weaknesses of contract costs. Security workers should be clearly defined and adhered to in order to be committed to crime prevention duties. A plan to support the cost of expenses as required by the legislation under review must be legislated to clarify the work of medical facility guards. Even if the contractor changes, the expertise of the guards should continue to be maintained. Third, crime prevention design should be expanded and the certification system should be institutionalized through evaluation method. The installation of emergency bells should be carefully considered the suitability of individual medical facilities. Furthermore, the CPTED strategy should be established by analyzing the US occupational safety and health cases.
