국문 초록

이 연구는 영국에서 민간보안산업법(PSIA) 제정과 더불어 탄생한 보안산업위원회(SIA)의 역할과 구체적인 규정내용을 살펴봄으로서 다가올 한국식 민간보안산업의 규제 및 관리 감독에 관한 시사점을 부각하고자 하였다. 첫째, 영국의 경우와 같이 수십 년이 지나고서 갈등 문제 해결점을 찾아 결국 민간보안산업법을 제정한 것처럼 우리 사회에 적합한 공인탐정제도의 입법화가 형성되어야 한다. 둘째, 영국의 민간보안산업법이 관리감독기관으로의 보안산업위원회를 지정하였듯이 최근 상정된 국회안건에 보안산업 관리감독의 중요성을 인식하고 상정안에 기관의 설정이 명확하게 포함되었으면 한다. 공적 치안기관과 민간 보안기관의 중간 위치에서 상호간 발생하는 문제를 해결하고 이해 증진을 도모하는 기능자 역할의 양자협의기구의 성격을 갖도록 제도적 권위가 뒷받침되어야 한다. 셋째, 영국의 보안산업위원회는 민간보안자격 표준 및 인증제도 설정을 통하여 보안산업체 및 종사자들의 전문성을 보장하며 각종 업무 영역별로 구체화된 자격제도로 면허제를 실시하고 있으며 그에 적합한 교육훈련의 요구사항 및 프로그램을 개발 육성하고 있다. 이에 우리나라 공인탐정제의 도입과 더불어 필요한 기능인 관리감독기관의 확립에 이바지하고자 하였다.

영문 초록

The purpose of this study was to highlight the role of the Security Industry Authority (SIA), which was created in conjunction with the Private Security Industry Act (PSIA) in the UK, and to highlight the implications for the regulation and management supervision of the Korean private security industry. First, several decades later, as in the case of the United Kingdom, we have to find a solution to the conflict problem and eventually form a proper private security industry law in Korea. Second, as the Private Security Industry Act (PSIA) of the United Kingdom has designated the Security Industry Authority (SIA) as an official supervisory authority, I would like to recognize the importance of the supervision of the security industry in the recently proposed legislative agenda and clearly include the establishment of institutions in the presumption. Institutional authority should be backed up to have the nature of a bilateral consultative body functioning as a function to solve mutual problems and promote understanding between public security agencies and private security organizations. Third, the UK Security Industry Authority (SIA) establishes a private security qualification standard and certification system to guarantee the professionalism of the security industry and its employees. And also SIA implements the qualification system that is specific to each business area. Therefore, the purpose of this study was to contribute to the establishment of a supervisory agency, which is a must function in along with the on-coming adoption of public detective system in Korea.
