미디어 접촉경험이 형사정책에 대한 인식에 미치는 영향

국문 초록

이 연구는 여론형성에 결정적인 영향을 미친다고 알려진 미디어가 실제로 형사정책에 대한 대중의 인식에 영향을 미치는가 그 관계를 경험적으로 검증해 보고자 하였다. 이 연구에서는 기존의 논의에서 주로 다루어져 온 신문과 TV와 같은 전통적 인 미디어 뿐 아니라 인터넷과 같은 뉴 미디어의 영향을 다루었다. 즉 각 유형의 미디어 뉴스에의 노출 정도와 미디어를 통한 범죄사건 접촉경험이 우리사회의 강력범죄 처벌수준에 대한 인식에 어떠한 영향을 미치며, 형사정책에 관한 서로 다른 두 가 지 입장, 즉 처벌 및 응보적(징벌적인) 또는 교육 및 치료적(예방적인) 형사정책에 대한 인식에 어떠한 영향을 미치는가를 검증하였다. 분석결과 첫째, 응답자들의 대부분이 미디어를 통하여 범죄소식을 접하고 있으며 특히, 인터넷 뉴스를 통해서 범죄 관련 소식을 접하는 경우가 매우 많다는 점을 확인할 수 있었다. 둘째, 응답자들은 우리사회에서 범죄에 대한 처벌이 관대한 편이라는 인식이 높았으며 특히, 강간범죄에 대한 처벌수준을 매우 관대하다고 인식하는 것으로 나타났다. 마지막으로 미디어 와 관련된 변인 가운데에서는 인터넷을 통한 범죄보도 접촉경험이 강력범죄 처벌수준에 대한 인식에 영향을 미치는 것으로 나타났는데, 인터넷을 통한 범죄보도를 자주 접할수록 우리사회의 강력범죄에 대한 처벌 수준이 관대하다고 인식하는 것으로 나타났다. 또한 신문을 통한 범죄보도를 자주 접할수록 처벌 및 응보적 형사정책을 지지하는 것으로 나타났다. 한편 인터넷 뉴스 이용 시간이 길어질수록 교육 및 치료적 형사정책 실시에 부정적으로 인식하는 것으로 나타났다.

영문 초록

With the mounting public interest in violent crimes as murder and sexual violence crimes, the government is actively coming forward for countermeasures of criminal policy and there is a prominent tendency of developing severe and strict punishment policies for sexual violence crimes. In fact, various studies have made an argument that the public preferring tough penalties due to the influence of media is also making effect on implementing severe punishment and strong criminal policy and sentencing decision by ordinary people and judges as well. The purpose of this study is to empirically verify an influencing relationship between media, which is known to make a decisive effect on forming public opinion, and political policies. This study investigated the effect of traditional media as newspaper and TV that existing arguments have mainly covered and the effect of new media as internet as well. Meaning, this study investigated how the degree of exposure to each type of media news on crime cases and to crime cases through media make effect on perception toward the punishment level of violent crimes of our society, and verified the effect on perception of the two different perspectives toward criminal policy as punishment and restorative(punitive) or educational and therapeutic(preventive) criminal policy. First, it was verified that the majority of respondents were hearing crime news through media, and specially, many of the respondents were hearing the crime news through internet. Secondly, respondents had high perception that punishment for crime, especially the level of punishment for rape, is rather lenient in our society. Lastly, among variables related to media, it was identified that exposure to crime report through internet makes effect on perception toward the punishment level of violent crimes and perceived the punishment level for violent crimes to be too lenient when they received crime reports through internet. Also, people who were exposed to the crime report through newspaper supported punishment and retributive criminal policies and people supported punishment and retributive criminal policies more when they heard crime report through newspaper often. On the other hand, it was identified that people perceived execution of educational and therapeutic criminal policy negatively when they spent more time using the internet news.
