국문 초록

현대사회는 누구든지 본인의 의지와 상관없이 범죄로 인한 피해에 노출되어 있으며, 특히 복잡하고 다양한 사회적 특성을 고려하면 범죄로 인한 피해의 여파는 매우 크게 나타난다. 범죄피해자에 대한 보호와 지원은 어느 특정분야의 책임이 아니라 우리사회 전체의 책임이라 할 수 있다. 특히 형사사법체계에 관여한 기관들 중 경찰단계에서의 피해자보호가 상대적으로 중요한 이유는 다른 여느 기관보다 범죄피해자를 처음 접하는 기관이며 초동수사에서 가장 가까이서 대면하게 되는 1차 접촉기 관이 될 가능성이 높기 때문이다. 경찰은 창립 70주년을 맞아 2015년을 범죄피해자보호의 원년으로 삼아 실질적인 피해자보호와 지원을 위한 다양한 노력을 시도하고있다. 이 연구에서는 범죄피해자와 피해자 보호에 대한 개념, 그리고 현재 경찰에서 시행중인 범죄피해자보호를 위한 정책과 제도를 검토하였다. 이를 통해 형사절차에서피해자 참여보장에 관한 문제와 사생활의 평온과 신변보호에 관한 문제, 범죄 유형 별 피해자 보호대책의 문제, 그리고 범죄피해자 보호기금의 운영과 경찰에 관한 문제를 확인하고 이를 개선하기 위한 방안에 대해 논의하였다. 경찰에서 제공하는 범죄피해자 보호제도와 지원정책이 실효성을 확보하기 위한 정책적 제언으로 첫째, 피 해자보호가 경찰 본연의 임무라는 피해자보호에 대한 인식의 전환이 필요하며, 둘째, 실질적 지원을 확보하기 위한 전담부서의 개편, 셋째, 현재 개별적으로 운영되는 지원제도의 통합, 마지막으로 범죄피해자 구조기금에 대한 경찰의 집행권한을 부여하는 방안을 제시하였다

영문 초록

In modern society, everyone is exposed to the damages caused by crimes regardless of their will, and especially considering the complex and diverse social characteristics, the aftereffects of the damages turn out to be varied. Protecting and supporting crime victims is a responsibility of our whole society, not of a certain sector. The reason that protection of victims in the level of the police among the organizations involved in the criminal judicial system is important is that they face crime victims more quickly and closely than any others. The police, considering year 2015 that is the 70th anniversary of its foundation as the first year of protection of victims, is making various efforts to actually protect and support victims. In this study, the concepts of crime victims and protection of victims were examined and the policies and systems being executed by the police for protection of victims were analyzed. Through this process, the problems of the guarantee of victims’ participation in the criminal procedure, peaceful life and protection, measures for protection of victims considering crime types, and management of protection funds for crime victims were examined, and appropriate improving measures were discussed. This study suggests political implications for securement of the effectiveness of the victim protection system and supporting policies provided by the police. First, the police should recognize that protection of victims is their essential duty. Second, they need to reorganize the exclusive division to secure actual support. Third, the present individual support systems should be integrated. Lastly, the police should be given the executive authority for crime victim aid funds.
