국문 초록

  본 연구는 2002.05.30 지적법의 헌법블합치 판결에 따른 지적법 개정으로 2004.01.01 지적측량업무의 일부가 개방된 이후 새로이 도입된 지적측량수행제도의 건전한 발전을 도모하는데 그 목적을 두고자 한다. 2004년부터 현재까지 개방업무를 중심으로 지적측량수행자의 업무처리현황을 분석한 결과 지적측량업무 영역의 한계, 개방업무 계약제도의 혼란, 지적측량기준점관리의 이원화, 개방업무 검사기관의 이원화 및 측량수행자의 미 차별화 등의 문제점을 도출할 수 있었다. 이러한 문제점들은 새로운 제도를 도입하면서 충분한 사전 검토가 이루어지지 않아 발생된 문제점이다. 따라서 본 연구에서는 개방업무를 중심으로 한 지적측량수행제도의 개선방안으로 개방업무 수행제도의 기반 강화, 개방업무 검사제도의 개선 및 지적측량시장의 확장 등을 제시하였다.

영문 초록

  The paper is a purpose that analyzed an open business as a part of cadastral surveying practice introduced 1 January 2004 after revision of the cadastral law affected by constitutional non agreement judgements in 30 May 2002. The result of analysis on current cadastral surveying companies from 2004 until currently has been shown the various problems such as limitation of cadastral surveying territory, confusing of contract processes of open business, dual management of cadastral control points, dual inspection of open cadastral surveying practice, and unfair registration of cadastral surveying companies. These problems became not sufficient discussion with stakeholder in order to introduce a whole competitive cadastral surveying practice. Thus this paper proposes complements for improving open cadastral surveying practice as improved framework of an open business institute, improvement of cadastral inspection survey processes, and extension of the cadastral surveying market based on whole competitive business.
