Comparative study of bullying case-handling systems: South Korea, the United States, the United Kingdom, and Canada

국문 초록

[연구목적] 본 연구는 한국, 미국, 영국, 캐나다(브리티시 컬럼비아주)의 학교폭력 사안 처리 정책을 비교·분석하여, 신속한 대응과 피해자 보호, 절차적 공정성, 교육적 회복을 실현하기 위한 정책적·실천적 대안을 도출하는 데 목적이 있다. [연구방법] 이러한 목적을 달성하기 위해 OECD 회원국 중 거버넌스 체계가 서로 다른 4개국(한국, 미국, 영국, 캐나다)을 선정하고, 관련 법령 및 지침, 학교 매뉴얼을 대상으로 문헌 분석하였다. 비교준거는 사안처리 절차, 피·가해자 분리조치, 학생 지원체계, 그리고 예방 및 대응의 교육적 접근으로 설정하였다. [연구결과] 주요 연구결과는 첫째, 4개국 모두 사안 인지-초기 대응-조사-조치 결정-이행 및 사후 관리의 절차를 갖추고 있으며, 피해자와 가해자 분리 조치를 보호적·예방적 장치로 운영하고 있다. 둘째, 한국은 학교폭력대책심의위원회와 학교폭력 제로센터를 중심으로 사안처리 절차를 체계화하였으며, 학생부 기재 유지기간 연장과 즉시 분리조치 일수 확대 등 피해자 중심의 보호조치를 강화하였다. 셋째, 미국은 주(州) 법령 및 교육구 정책에 따른 분권형 체계로, 학교장이 사건을 인지하는 즉시 조사를 실시하고 표준양식으로 보고하며, 사안의 수준에 따라 개별 안전계획 수립과 단계적 징계조치를 병행하도록 규정하고 있다. 넷째, 영국은 학교장과 지정 안전책임자(DSL) 중심의 학교기반 대응과 아동보호기관과의 연계를 통해 대응의 전문성과 책무성을 확보하고 있으며, 캐나다(브리티시 컬럼비아주)는 학교, 경찰, 정신 건강, 복지기관이 참여하는 다기관 협력체계를 제도화하여 학교폭력을 지역사회 공동 대응 과제로 다루고 있다. [결론] 국제비교를 통해 학교폭력 예방 및 대응을 위한 제도적, 정책적 측면에서 우리나라의 학교폭력 사안 처리에 적용할 수 있는 시사점을 도출하였다.

영문 초록

[Purpose] This study compares school‑violence case-handling systems in South Korea, the United States, the United Kingdom, and Canada (focusing on British Columbia) to identify transferable practices that ensure prompt response, victim protection, procedural fairness, and educational restoration. [Methods] We conducted a cross-national policy analysis of statutes, regulations, official guidance, and school‑level manuals. Four comparative criteria guided the analysis: (1) case-handling procedure; (2) victim–perpetrator separation measures; (3) student support systems for victims and perpetrators; and (4) educational approaches to prevention and response. [Results] Across all four systems, case-handling procedures are time-bound from intake to follow-up, and separation is framed as a protective rather than punitive measure.Korea implements a nationally standardized process anchored by deliberative committees and School Violence Zero Centers. The U.S. follows a decentralized, statute-driven model in which principals lead investigations under state-defined procedures, combining individualized safety plans with graduated discipline. The UK emphasizes school-based responses led by head teachers and Designated Safeguarding Leads, supported by multi‑agency child‑protection coordination and Ofsted oversight. British Columbia institutionalizes a multi‑agency, risk-assessment framework with staged intervention and periodic reviews. Across countries, support systems and preventive-educational approaches increasingly adopt restorative and multi-tiered strategies that integrate psychological support, educational rehabilitation, and whole-school climate initiatives. [Conclusion] This international comparison yields implications–particularly regarding educational approaches and multi-agency collaboration–that can inform the further development of Korea’s school violence case-handling system.
