자치법규 입법영향분석 고찰: 경기도 조례를 중심으로

국문 초록

본 연구는 지방자치단체의 자치법규가 주민의 권리와 의무, 그리고 일상생활에 미치는 직접적 영향을 고려할 때, 조례 입법의 품질 제고를 위한 제도적 장치로서 입법영향분석 제도(Legislative Impact Analysis)의 중요성을 고찰한 것이다. 연구의 중심 대상은 경기도의 「자치법규 입법영향분석 조례」로, 제도 도입의 배경과 운영 실태를 분석하고, 독일·미국·일본 등 주요국의 입법평가 사례를 비교함으로써 한국형 지방입법평가제도의 개선 방향을 제시하였다. 경기도는 2014년 입법영향분석제도를 도입하여 사전·사후 분석 절차를 병행함으로써 조례의 타당성과 정책효과를 과학적으로 검증하는 선도적 모델을 제시하였다. 그러나 의원발의 중심의 조례 제·개정 과정에서 정책 수요조사나 주민의견 수렴 절차가 충분히 이루어지지 못하는 등 실효성의 한계도 존재한다. 이에 본 연구는 ① 사전·사후 연계형 순환평가체계 구축, ② 정량·정성 지표의 표준화, ③ 주민참여형 거버넌스 평가모델 도입, ④ 독립적 평가조직 설치 및 법적 근거 강화를 주요 개선 과제로 제안하였다. 또한 해외사례 분석을 통해, 독일의 GFA(Gesetzesfolgenabschätzung)는 비용·편익 중심의 과학적 정량분석을, 미국의 RIA(Regulatory Impact Analysis)는 정책효과성 및 주민참여 중심의 실증평가를, 일본의 행정평가제도는 정책책임성과 행정 효율성을 결합한 복합평가모델을 구현하고 있음을 확인하였다. 이러한 비교분석을 토대로, 한국의 지방자치단체는 과학적 분석과 주민참여가 결합된 순환형 입법평가체계를 확립함으로써 지방입법의 품질과 민주적 정당성을 제고할 필요가 있다. 결국 본 연구는 입법영향분석을 지방자치의 실질적 발전을 견인하는 제도적 장치로 보고, 정책의 투명성·효율성·책임성을 강화하는 과학적 입법관리 체계의 구축 방향을 제시하였다는 점에서 의의가 있다.

영문 초록

This study examines the significance of the Legislative Impact Analysis (LIA) system as an institutional mechanism to enhance the quality of local legislation, recognizing that municipal ordinances directly affect the rights, obligations, and daily lives of residents. Focusing on Gyeonggi Province’s Ordinance on Legislative Impact Analysis of Local Regulations, this research analyzes its institutional background and operational status, while comparing it with legislative evaluation systems in Germany, the United States, and Japan to propose policy directions for improving Korea’s local legislative evaluation system. Since introducing the LIA system in 2014, Gyeonggi Province has established a pioneering model that scientifically verifies the validity and policy effects of ordinances through both ex-ante and ex-post analyses. However, limitations remain, such as insufficient policy demand assessments and lack of public participation in council-initiated legislative processes. Accordingly, this study suggests four key improvement measures: (1) establishing a cyclical evaluation framework that links ex-ante and ex-post assessments; (2) standardizing quantitative and qualitative indicators; (3) introducing a participatory governance-based evaluation model; and (4) ensuring institutional independence and legal authority of evaluation bodies. Comparative analysis of foreign cases reveals that Germany’s Gesetzesfolgenabschätzung (GFA) emphasizes scientific cost–benefit evaluation, the United States’ Regulatory Impact Analysis (RIA) focuses on empirical assessment and citizen participation, and Japan’s administrative evaluation system integrates policy accountability and administrative efficiency through a multi-layered evaluation model. Building upon these insights, this study argues that Korean local governments should establish a scientific and participatory legislative evaluation framework that continuously enhances the quality and democratic legitimacy of local legislation. Ultimately, this study underscores that legislative impact analysis serves as an essential institutional tool for the substantive advancement of local autonomy and proposes the direction for building a transparent, efficient, and accountable legislative management system in Korea.
