국가 우주법 체계 법적 검토

국문 초록

우주는 과학기술의 발전과 경제적 가치의 확대, 국가안보적 중요성 증대로 전략적 영역으로 자리매김하고 있다. 우리나라는 항공우주 분야의 법제를 지속적으로 발전시켜 왔으며, 2005년 「우주개발 진흥법」 제정을 통해 본격적인 우주법 체계를 구축하였다. 2024년 「우주항공청의 설치 및 운영에 관한 특별법」 제정과 우주항공청 개청으로 우주개발 추진체계가 새로운 전환점을 맞이하였다. 그러나 급증하는 민간 우주활동의 확대 등 과제 앞에서 현행 법체계는 여러 한계를 드러내고 있다. 본 연구는 국내 우주법의 발전과정과 현황을 행정법적 관점에서 체계적으로 분석하고, 주요 법적 쟁점과 개선과제를 도출하였다. 우주의 법적 특수성과 국내 우주법의 법원을 검토하고, 정책·계획, 인공우주물체 등록, 우주발사체 발사허가, 성능검사 등 주요 행정행위의 법적 성격을 분석하였다. 이를 통해 우주활동 허가·감독 제도 등 규제체계의 보완, 손실보상 체계의 개선 등을 도출하였다. 특히 현행 제도는 우주발사체 발사허가에 집중되어 있으나 위성 운영 등에 관한 허가 제도가 부재하다는 근본적 한계가 있다. 미국, 프랑스, 일본 등 주요국은 우주활동 전반에 대한 포괄적 허가체계를 구축하고 있는 것을 참조하여 우리나라도 반복 발사 절차 개선, 인공위성 허가제도 도입, 인공위성 운용자 면허 및 안전감독 제도 도입, 발사장 허가제도 마련 등의 제도 개선이 시급하다. 발사 및 위성 허가제도를 보완하고, 위성 데이터 보호 규정, 우주쓰레기 완화의 법제화 등도 요구된다. 국내 우주법은 국제우주법 내지 글로벌 행정법과 국내 행정법의 공진화 관점에서 발전해야 하며, 국제 우주법의 원칙과 의무를 실현할 수 있도록 국내 법체계를 설계하되, 우리나라의 법체계와 우주현황에 맞는 독자적 규범체계를 구축해야 한다.

영문 초록

Outer space is establishing itself as a strategic domain due to the advancement of science and technology, the expansion of economic value, and its increasing importance to national security. The Republic of Korea has continuously developed its legislation in the aerospace sector and established a full-scale space law framework through the enactment of the Space Development Promotion Act in 2005. The governance of space development reached a new turning point in 2024 with the enactment of the Special Act on Establishment and Operation of Korea Aerospace Administration and the subsequent opening of the Korea Aerospace Administration (KASA). However, the current legal system reveals several limitations in the face of challenges such as the rapid expansion of private space activities. This study systematically analyzes the development process and current status of domestic space law from an administrative law perspective and derives major legal issues and tasks for improvement. It reviews the legal specificity of outer space and the sources of law regarding domestic space law, and analyzes the legal nature of major administrative acts such as policies and plans, registration of space objects, permission for launch of space launch vehicles, and performance inspections. Through this analysis, the study proposes the supplementation of the regulatory framework, including the licensing and supervision system for space activities, and the improvement of the system for compensation for loss. In particular, the current system has a fundamental limitation in that it is concentrated on permission for space launch vehicles, while a licensing system for satellite operations is absent. Drawing upon the examples of major countries such as the United States, France, and Japan, which have established comprehensive licensing systems for overall space activities, it is urgent for Korea to implement institutional improvements. These include streamlining procedures for repetitive launches, introducing a satellite licensing system, establishing a license system for satellite operators and safety supervision, and creating a permission system for launch sites. Furthermore, complementing the launch and satellite licensing regimes, regulations on the protection of satellite data, and the legislation of space debris mitigation are also required. Domestic space law must develop from the perspective of co-evolution between international space law—or global administrative law—and domestic administrative law. While the domestic legal system should be designed to realize the principles and obligations of international space law, an independent normative system tailored to Korea's legal system and the current status of its space sector must be established.
