국가 AI 대전환 시대의 AI 안전 확보 방안과 개헌의 필요성

국문 초록

대한민국의 ‘진짜 성장’을 위한 5대 과제가 있다. 그중에서 제1대 과제가 ‘AI 3대 강국 진입과 미래 전략산업 육성’이다. 이러한 전략 아래 세부 정책 목표를 살펴보면, 다양한 세부 실행계획들이 존재한다. 첫째, 인공지능 대전환(AI Transformation: AX)을 통해 AI 3강으로 도약, 둘째, 인공지능 거버넌스 정립을 통해 AI 3강의 기반을 마련, 셋째, 세계 최강의 AI 인프라 구축, 넷째, AI 시대, 차세대 첨단기술 개발과 투자 강화, 다섯째, 손쉽고 안전한 데이터 활용을 위한 법·제도 마련, 여섯째, 교육혁신으로 AI 인재 양성 강국으로 도약, 일곱째, 사람 중심의 AI 미래 교육 강화, 여덟째, ‘모두의 AI’ 국민 누구나 AI를 쉽고 편리하게 사용할 수 있는 나라 추진 등이 바로 그것이다. AI 발전이 가져올 수 있는 세계적인 경쟁력을 통해 대한민국을 AI 3대 강국으로 도약하도록 국정과제를 수립하고 있다. 법학자들을 중심으로 제기되는 AI의 편향성, 불공정성 등 다양한 걱정과 우려는 사실 AI 기술 발전의 고도화를 통해서도 극복할 수 있는 부분이 있으며, 민간 영역에서 AI 기술을 독점하여 이를 기업의 극대 이윤 추구의 수단을 삼으려는 시도를 잘 파악하고 있기 때문에, 오롯이 민간 영역에만 AI 기술 발전의 문제를 맡기지 않고, 공적 영역에서도 막대한 국가 예산을 투하하여 AI 기술 발전을 통한 국민경제의 성장과 국민 편익의 증대를 목표로 할 필요가 있다. AI의 부정적인 요소는 AX를 통한 세계 기술 주도적인 국가로 성장하면서 기술 기반 해법을 통해 극복해야 할 것이다. AI 3대 강국·세계 5대 경제 강국으로 도약하려는 목표를 달성하기 위해서는 국가의 근본 규범인 헌법개정을 통해 AI 시대 변화를 수용하고 이를 뒷받침할 규정을 마련할 필요가 있다.

영문 초록

There are five tasks for ‘real growth’ in Korea. Among them, the first task is to enter the three major AI powerhouses and foster future strategic industries. Looking at the detailed policy goals under this strategy, there are various detailed plans. First, through the AI Transformation (AX), it leaps into the three AI powers, second, it lays the foundation for the three AI powers through the establishment of artificial intelligence governance. Third, it establishes the world’s strongest AI infrastructure, fourth, the AI era, the development of next-generation advanced technologies and strengthening investment, fifth, the establishment of laws and systems for easy and safe data utilization, and sixth, it is to leap into a powerhouse to cultivate AI talents through educational innovation, seventh, strengthening people-centered AI future education, and eighth, promoting a country where everyone can use AI easily and conveniently. It is establishing a national task to make Korea leap into the three AI powers through the global competitiveness that AI development can bring. In fact, various concerns and concerns, such as AI bias and unfairness raised by jurists, can be overcome through the advancement of AI technology, and since we are well aware of attempts to monopolize AI technology in the private sector and use it as a means of pursuing maximum profits for companies, AI technology development aims to grow the national economy and increase national benefits by creating a huge national budget rather than leaving the issue of AI technology development to the private sector alone. Measures against the negative elements of AI are to grow and develop into the world’s technology-led country through AX, making the leap to become one of the world's top three AI powerhouses and the top five economic powers, so we need to start from the perspective of regulation and control, but we need to eventually accept the changes in the AI era and establish the constitution as a fundamental national normative system to support them.
