국문 초록

본 연구는 형사재판에서 과학적 증거가 높은 증명력을 갖기 위해 수사 단계에서 충족되어야 할 요건과 제도 개선 방안을 고찰하는 것을 목적으로 한다. DNA, 지문, 족적, 체액, 위드마크 공식 등 다양한 과학적 증거물에 대한 최근 판례를 분석하고, 증명력 판단 시 핵심이 되는 동일성, 무결성, 신뢰성의 쟁점을 중심으로 주요 문제를 도출하였다. 분석 결과, 감정 결과의 정밀성만으로는 충분하지 않으며, 감정자료의 출처 확인, 오염 방지, 과학적 감정 절차 이행 여부 등이 충족되어야 높은 증명력이 인정됨을 확인하였다. 특히 과학적 증거가 단독으로 존재하는 경우, 보강증거의 존재 여부는 해당 증거의 증명력 정도를 판단하는 주요 기준이 되는 것으로 나타났다. 본 연구는 이러한 분석을 바탕으로, 증거의 수집·보관·이송·감정 전 과정에서 절차적 투명성과 기록, 각 증거의 유형별 특성과 증거 수집부터 해석과정에 내재된 위험 요인의 실증적 분석을 통해 수사단계에서 과학적 증거의 실질적인 증명력을 제고할 수 있는 방향을 제안하였다.

영문 초록

This study aims to examine the requirements and institutional improvements necessary for scientific evidence to serve as credible proof in criminal trials. Through an analysis of recent court rulings involving various forms of scientific evidence—including DNA, fingerprints, footprints, bodily fluids, and the Widmark formula—the study identifies key issues related to the legal evaluation of such evidence, focusing on identity, integrity, and reliability. The findings indicate that the precision of forensic results alone is insufficient; rather, the origin of the specimen, prevention of contamination, and adherence to scientifically established procedures must be ensured for the evidence to be given strong probative value. In particular, in cases relying on a single piece of evidence, the presence of corroborating evidence was often a critical factor in judicial evaluation. Based on these findings, the study proposes measures to enhance the probative value of scientific evidence through procedural transparency, consistent documentation throughout the collection, preservation, transfer, and analysis stages, and empirical analysis of risk factors inherent in each type of evidence and its interpretation process.
