국문 초록

In the era of digital economy, the core competitiveness of platform enterprises increasingly relies on their ability to acquire and utilize data resources, and the imbalance of data element allocation has become a structural problem. With the continuous strengthening of control over data resources by very large platforms, the traditional principle of freedom of contract is facing systematic failure in data trading scenarios, and small and medium-sized market entities are trapped in the dilemma of “data islands” due to platform monopolies, making it difficult for them to participate in market competition fairly. Based on this, the traditional mandatory contracting system should be extended to the field of digital platforms, and an institutional framework based on platform classification, limited necessary data as the scope, and standardized format contracts as the performance mechanism should be constructed. This is an important path to correct the imbalance of data factor markets, achieve fair competition and substantive justice, and is also an institutional innovation choice to respond to governance challenges in the digital economy era.

영문 초록

数字经济时代，平台企业的核心竞争力日益依赖于对数据资源的获取与利用能力，数据要素配置失衡已成为结构性难题。随着超大型平台对数据资源控制力的持续强化，传统契约自由原则在数据交易场景下面临系统性失灵，中小市场主体因平台垄断而陷入“数据孤岛”困境，难以公平参与市场竞争。基于此，应当将传统强制缔约制度延伸至数字平台领域，构建以平台分级为基础、限定必要数据为范围、以标准化格式合同为履行机制的制度框架，方能矫正数据要素市场失衡、实现公平竞争与实质正义的重要路径，亦是回应数字经济时代治理挑战的制度创新选择。
