국문 초록

본 연구는 한국 시민사회가 양적･질적으로 성장했음에도 불구하고 자기 제도화에 반복적으로 실패해 온 역설적 현상에 주목한다. 지난 30년간의 시민사회기본법 입법 추진사를 정치적 기회구조의 변화와 행위자 전략의 상호작용 과정으로 이해하며, 반복된 입법 실패를 통해 드러난 제도화의 한계와 향후 전략적 재설계 방향을 고찰하는 것을 목적으로 한다. 이를 위해 1987년부터 2025년까지를 네 시기로 구분하여 시기별 정치사회적 맥락과 담론 변화를 분석하고, 14대부터 21대 국회에 발의된 6개 주요 법안을 체계적으로 비교･검토하였다. 분석 결과, 시민사회기본법 입법 추진의 30년은 △담론의 진화와 심화, △정치적 기회구조 의존의 한계, △제도화 경로의 우회화, △시민사회 내부 역량의 점진적 축적이라는 네 가지 구조적 특징을 보여준다. 특히 법률의 성격이 ‘개별 조직 지원법’에서 ‘기본법’으로, 시민사회에 대한 국가의 인식이 ‘통제 대상’에서 ‘민주주의의 필수 구성요소’로 전환된 점은 중요한 진전으로 평가된다. 그러나 이러한 철학적･전략적 발전에도 불구하고, 기금 설치나 전담 조직 설치 등 실효성을 담보할 핵심 장치들이 오히려 약화되는 모순적 양상도 드러났다. 이는 시민사회 내부의 분화와 전략적 조율의 한계, 그리고 정치적 제약이 복합적으로 작용한 결과이다. 본 연구는 시민사회기본법이 단순한 ‘지원법’이 아니라, 시민사회의 공공적 역할을 제도적으로 보장하고 민주주의의 토대를 강화하는 ‘기본법’으로 확립되어야 함을 강조하며, 이를 위한 제도적･정책적 재설계 방향을 제안한다.

영문 초록

This study explores the paradox that Korean civil society, despite its quantitative and qualitative growth over the past three decades, has repeatedly failed to institutionalize itself through legislation. It examines the legislative history of the Basic Act on Civil Society as an interactive process shaped by shifting political opportunity structures and the strategic responses of key actors. The research identifies structural causes of repeated legislative failures and proposes directions for strategic redesign. The period from 1987 to 2025 is divided into four phases, analyzing political and social contexts and the discursive responses of civil society. Six major bills from the 14th to 21st National Assemblies are analyzed across six domains: legal titles, definitions, state responsibilities, policy tools, funding, and implementation. Data sources include primary documents, interviews with key participants, and participatory observation. Findings reveal four structural patterns: evolving discourse, overdependence on political conditions, circumvention in institutionalization, and the gradual accumulation of internal capacities. Despite philosophical and strategic progress—such as reframing the law as foundational and recognizing civil society as integral to democracy—key provisions like funding and agency establishment have regressed. This reflects a convergence of political constraints and internal fragmentation. The study concludes that the Basic Act should serve as a legal framework affirming civil society’s autonomy and democratic role as a public covenant.
