학교전담경찰관 제도의합리적 개선방안에 관한 연구

국문 초록

2011년 대구에서 학교폭력 피해를 입은 중학생이 자살한 사건이 촉매가 되어 학교폭력에 대한 범정부적 근절 대책이 마련되었고, 이 과정에서 전국적으로 시행된 것이 학교전담경찰관 제도이다. 그 후 지금까지 운영되는 과정에서 학교폭력이 지능화·흉폭화·집단화하고 피해학생이 그로 인해 사망하거나 피해학생의 사진이 SNS등에 게재되어 국민적 공분을 자아내면서 학교폭력의 실질적 예방 필요성이 제기되는 가운데 학교전담경찰관 제도도 이에 맞추어 문제점을 탐색하고 합리적으로 개선할 필요성이 있다. 선행연구들은 학교전담경찰관의 활동이 지역사회와 연계되어야 하고, 범죄에 대한 처벌 중심에서 선도·교화 중심으로 가야 한다고 역설한 바 있다. 기본적으로 이러한 주장에 동감하면서, 필자는 경찰조직의 관련 부서에 근무한 경험과 일선의 학교전담경찰관 의견을 토대로 변화하는 학교폭력 경향에 대처해야 할 학교전담경찰관 제도의 개선방안을 조직적 측면, 학교 등 지역사회와의 협조 측면, 선도활동의 질적 개선 측면으로 나누어 살펴보았다. 우선, 학교전담경찰관 편제를 위기청소년의 실질적 관리를 통한 학교폭력 예방이 가능하도록 변화시킬 필요가 있다. 현재의 학교전담경찰관들은 경찰서 여성청소년계에 소속되어 근무하는데, 소속 계장이 이외에도 아동안전, 실종예방 등 많은 업무를 다루는 등 통솔범위가 지나치게 넓어 실질적 관리·감독이 어려우며, 학교전담경찰관의 다양하고 전문적인 업무수행이 조직 내에서 비중있게 다루어지지 못하는 가운데 인사상 불리함을 안고 있어 잦은 교체, 베테랑 부재 등의 현상과 전반적인 근무사기 저하 문제가 나타나고 있다. 이에, 학교전담경찰관들로만 구성된 별도의 학교전담팀을 만들어, 팀장에게 실질적인 관리·감독권한을 줄 것을 제안한다. 이를 통해 학교전담경찰관의 실질적인 학교폭력 예방활동이 가능해지고, 이들이 장기간 근무의욕을 갖고 근무할 수 있는 여건도 마련할 수 있을 것이다. 또한, 학교와 경찰의 학교폭력 관련 정보 공유가 활성화되어야 한다. 아직, 개인정보라는 이유로 양자간 협조가 되지 않는 경우가 많다. 학교전담경찰관의 경우 1인당 11개교 이상을 담당하고 있어 현실적으로 폭력이나 비행이 우려되는 학생 관련 정보를 인지하는데 한계가 있다. 이에, 눈에 드러나지 않아도 범죄 우려가 높은 학생들 관련 정보를 잘 알고 있는 학교 측에서 학생생활부장 교사 등이 학교전담경찰관과 정보를 공유하여 공동으로 이들을 관리할 수 있다면, 사회적 공분을 자아내는 큰 폭력범죄와 안타까운 희생자 발생도 막을 수 있을 것이다. 이를 위해 현행 학교폭력 예방 및 대책에 관한 법률 등 법적 근거의 개정도 필요하다. 그리고, 학교전담경찰관이 행하는 청소년 선도활동이 양적 활동에서 질적 활동으로 개선되고, 활동의 주요 포인트도 변화하는 학교폭력 추세에 따라가야 한다. 현재의 주요한 선도활동 중 하나가 선도프로그램 운영인데, 얼마나 많은 소년범 등을 프로그램에 연계하였느냐가 성과지표로 반영되어 학교전담경찰관들이 다수의 청소년을 연계하는 양적 활동에 치중하고 있다. 하지만, 단순 비행 청소년과 폭력전과가 있는 청소년은 달리 선도해야 한다는 점에서 후자의 경우 질적으로 깊이 있는 교육이 가능하도록 차별화된 선도프로그램 운영 방안을 마련할 것을 제안한다. 또한, 여러 학교 학생들이 연합하여 폭력범죄를 저지르는 서클의 해체에 집중하고, 학교폭력으로 인한 피해학생이 자살 등 극단적 선택을 하지 않도록 학교 및 지역사회와 협력하여 위기징후를 사전 포착, 보호하는 등 추세에 따른 경찰활동의 변화와 집중이 필요함을 제언하는 바이다.

영문 초록

As a catalyst was the suicide of a middle school student who was hit by school violence in Daegu in 2011, a pan-governmental anti-bullying measure against school violence was prepared, and the School Police Officer system was implemented nationwide in the process. Since then, in the course of operations so far, school violence becomes intellectual, extreme violent, and collective and the victim suicides or a photo of the victim gets on SNS, the School Police Officer system needs to search for problems and make rational improvements. Previous researches have stressed that the activities of School Police Officers should be linked to the community, and that they should focus on guiding and socializing from the punishment for crimes. Basically, I agree with these arguments, and based on my experience working in the relevant department of the police organization and the opinion of the School Police Officers, I divided the improvement of the School Police Officer system into organizational aspects, cooperation with the local community, school etc. and quality improvement of the guiding activities. First, we need to change the system of School Police Officers so that they can prevent school violence through actual management of crisis juveniles. Currently, School Police Officers are affiliated with the section of women & juvenile in police station. In addition, it is difficult the chief of section who deals with many tasks such as children’s safety and prevention of missing persons to manage and supervise staffs. As the various professional practices of the School Police Officers are not dealt with seriously in the organization, they have disadvantages in personnel, problems such as frequent replacement, absence of veterans, and overall decline in morale of duties are surfaced. Therefore, I propose that we make a separate School Police Officer’s team consisting of only school police officer and give the team leader the authority to manage and supervise school affairs practically. This will allow School Police Officers to prevent actual school violence and provide conditions for their long-term desire to work. Also, schools and police should be able to share information on school violence. Yet, there are many cases that bilateral cooperation is not possible due to sensitivity of personal information. As School Police Officers are in charge of more than 11 schools per a person, there is a limit to recognize information related to students who are afraid of violence or delinquency. Thus, if schools including director teacher of student life guide, which are well aware of students who are afraid of crimes even if they are not seen, can share information with the School Police Officer, and manage them jointly, they can prevent the occurrence of violent crimes and tragic victims that makes public rages. To this end, the law on school violence prevention and countermeasures needs to be revised. In addition, juvenile guiding activities conducted by School Police Officers should be improved from quantitative to qualitative activities, and major points of activity should be followed by changing school violence trends. One of the guiding activities in the present day is the operation of a guidance program, and the performance index reflected how many juvenile criminals were linked to the program, so School Police Officers focus on quantitative activities that link a large number of juveniles. However, it is suggested that the latter have a differentiated guidance program so that a qualitative and deep education can be achieved in the sense that simple delinquents and juveniles with violent battles should lead differently.
