자치경찰제 도입에 관한 시민 인식태도 연구

국문 초록

이 연구에서는 문재인 정부 이후 보다 적극적으로 논의되고 있는 자치경찰제를 실현하기 위한 대안모색의 차원으로 자치경찰제 도입에 필요한 여러 논점들에 대하여 가장 직접적 영향 당사자이자 중요한 의결 주체인 시민의 인식을 실증적으로 분석하였다. 또한 이를 통해 우리나라가 도입해야 할 합리적 자치경찰제 시행방안을 모색하고자 하였다. 연구결과 시민들은 전반적으로 자치경찰제 도입을 찬성하는 것으로 나타났다. 보다 구체적인 연구결과를 살펴보면, 첫째, 바람직한 자치경찰제가 도입되기 위해서는 가칭 ‘자치경찰시민위원회’와 같은 정치적 중립성을 유지할 수 있는 다양한 방안들이 마련되어야 하며, 주민 생활 밀착형 치안서비스를 제공할 수 있도록 지역특성을 감안한 자치경찰제 도입 모형을 우선 설정하는 것이 필요할 것으로 분석되었다. 둘째, 국가경찰과 자치경찰 간의 업무 중복 및 협조 부족의 우려를 불식시키기 위해 국가경찰과 지방자치단체 간의 효과적인 사무배분을 위한 법·제도적 보완이 우선적으로 마련되어야 하고, 충분한 인력수급 방안을 수립하고 지역 특성에 맞는 치안정책을 발굴한 이후 체계적으로 자치경찰제를 도입해야 한다는 연구결과도 도출되었다. 셋째, 광역 단위 자치경찰제 모형을 기본으로 강력·정보·보안·외사등 중요 국내·외 범죄 등을 제외한 경미한 일반적 범죄에 대해서는 자치경찰에게 수사권을 부여하는 방안이 합리적이기 때문에 이에 대한 법·제도적 협의가 시급한 것으로 나타났다. 넷째, 자치경찰의 조직 및 인사·예산과 관련된 부분에 있어서는 대표성 있는 합의제 형태의 경찰위원회를 통해 관리하는 방안을 통해 국가경찰에 자치경찰로 전환되도록 하고 지방재정 자립도 편차 등을 고려하여 현재의 국가경찰 예산을 자치경찰로 전환하는 등 국가가 상당 부분의 재정을 부담하는 것이 가장 타당한 방안으로 판단된다. 끝으로 시민들은 보다 적극적인 참여기회 보장을 요구하고 있으므로 앞으로 자치경찰제와 관련된 모든 정책 결정과정에서 시민들의 참여를 보장하고 그들의 의견을 적극 수렴할 수 있는 장치를 확대해야 할 것으로 보인다.

영문 초록

This study conducted empirical analysis on the perception of citizens - the most directly influencing principal as well as important decision-maker - as to a number of issues related with the introduction of local & municipal police system in an effort to find alternatives to realize autonomous police system that is under discussion more positively since the inauguration of Moon Jae-in government. Through this, the study sought to identify methods to implement reasonable local & municipal police system our country has to adopt. As a result, the study found citizens were generally in favor of the introduction of the local & municipal police system. Specifically, the crucial point to introduce the ideal local & municipal police system was to prepare diverse methods to maintain political neutrality such as 'Citizens' Association for local & municipal Police' (tentatively), and establishing the model to introduce local & municipal police system considering local traits in the first place was needed so that security service facilitating citizen's ordinary life could be provided. Secondly, in order to eradicate citizens' concern with work duplication between national police and local & municipal police, and lack of mutual cooperation, legal and systematic supplementation is needed above all for effective work distribution between the two parties. There turned out also need for the systematic introduction following the establishment of sufficient manpower measures and developing security policy in accordance with local traits. Thirdly, as for minor and general crimes excepting violent offences, information, security and external affairs, it is reasonable to assign investigation right to local & municipal police based on the model of metropolitan-level local & municipal police system and so legal and institutional discussion on this was urgently required. Fourthly, the field of organization, personal affairs and budget of local & municipal police had better transfer the relevant rights to local & municipal police from national police by means of police committee in the form of collegiate system of representatives. While, central government could ideally take burden on the financing matter by transferring the current national police budget to autonomous police in light of the gap of independence of local government's finance. Lastly, the citizens demanded to have more aggressive participation and so their participation should be guaranteed in the process of decision-making of all policies related with local & municipal police system in the future and more systems should be made to accommodate their opinions.
