특별사법경찰의 범죄수사 실태에 대한 실증적 고찰

국문 초록

본 연구의 목적은 각종 행정법 위반 범죄의 수사를 위해 도입되는 특별사법경찰(이하 특사경)이 일반 사법경찰을 보충하여 제대로 수사기능을 수행하고 있는지 사례를 통해서 실증적으로 분석하고자 하는 것이다. 특사경이 지속적으로 확대되고 있는데, 수사의 비전문성과 무관심으로 수사보다는 단속에 치중하고 단속결과를 경찰이나 검찰에 수사 의뢰하는 방식으로 단순히 ‘1차 수사기관’으로서 업무를 처리하고 있다는 비판이 제기된다. 본 연구에서는 서울시 민생사법경찰단과 자치구 특사경의 사례를 살펴본다. 범죄사건을 어떤 방식으로 처리하는지 각종 범죄통계 자료를 분석하고, 특히 기초지방자치단체 단위의 특사경 활동에 대한 보다 깊은 이해를 위해서 자치구 특사경의 범죄수사 실태조사와 설문조사를 실시하였다. 분석결과를 토대로 도출한 정책적 함의는 다음과 같다. 첫째, 특사경이 도입되어도 특사경 조직과 활동을 강화하지 않으면, 특사경은 단속업무만을 수행하고, 수사는 수사 전담조직인 민생사법경찰단이나 일반 사법경찰에 의뢰하는 실태를 확인할 수 있었다. 이를 극복하기 위해 전문수사조직이 필요하며, 그 이전이라도 업무에 대한 자부심 강화, 교육을 통한 수사실무 능력 배양, 조사실과 장비 등 여건을 개선할 필요가 있음을 제시하였다. 둘째, 수사 전담 조직형성은 특사경 도입취지와 논리적 모순이 따른 다는 점이다. 셋째, 이 문제를 해결하기 위해서는 특사경의 행정 전문성은 수사관 개인영역을 넘어서 조직차원의 전문성으로 개념적 확장이 필요하다. 넷째, 특사경 수사 전담조직을 광역자치단체에 둘 것인지, 아니면 기초지방자치단체에 두어야 하는가의 문제이다. 이는 그 분야의 행정적 특성, 수사전문성, 지역사회의 영향 등을 종합적으로 고려하여 결정하여야 하며, 특사경이 일반 사법경찰과의 관계에서 보충적 기능을 효과적으로 수행하기 위한 기본 전제이다.

영문 초록

The purpose of this study is to empirically analyze through case analysis whether special judicial police, which was introduced to investigate violations of all kinds of administrative law, is performing its investigative function properly. Despite the fact that special judicial police is on the rise of expansion, there has been criticism that it merely function as a primary investigation agency with lack of professionalism and interest in investigation, focusing more on control than investigation and requesting police or prosecution for investigation of the results of control. This study examines some of the cases of Seoul’s Judicial Police Bureau and other special judicial police in autonomous districts of Seoul. By analyzing various kinds of criminal statistics data, this study deals how each criminal case is handled and it also conducted survey on the status of special judicial police in autonomous districts for the deeper understanding of special judicial police on local government level. The policy implications derived from the results of analysis are as follows: first, it was verified that unless its organization and activities are intensified, special judicial police may only perform control tasks, requesting special judicial police bureau or general judicial police to conduct investigation; As a partial solution, this study suggests that special judicial police in autonomous districts needs to establish a specialized investigative organization within itself, and preceding this, that the working conditions should be improved by encouraging the workers take pride in their work, cultivating practical qualifications in investigation through education, and improving conditions of facilities such as investigating rooms and equipment; second, however the current status of specialized organization for investigation contradicts the introduction of special judicial police; third, therefore it is necessary that we extend the concept of a special judicial police officer’s expertise in administration to an organizational level, not an individual one; fourth, it still raises a question whether to place special investigation organization of special judicial police within metropolitan government or local government. This issue needs to be decided after overall consideration of various issues such as nature of administration, expertise in investigative area, and its influence within the local community. This should be the basic premise for special judicial police to perform its supplementary function effectively in its relationship with general judicial police.
